2. Have Third Energy Limited, or any other company trading under the name of Third Energy whose parent company is Third Energy Holdings Limited, registered in the Cayman Islands, ever received remuneration from depositing or storing any substances within any of their British on-shore well-shafts, including all wells that have been either decommissioned or suspended?

3. Have Third Energy Limited, or any other company trading under the name of Third Energy whose parent company is Third Energy Holdings Limited, registered in the Cayman Islands, ever agreed to deposit or store any substances within any of their British on-shore well-shafts, including all wells that have been either decommissioned or suspended, as any part of a research and development programme?

Is there any way possible that Third Energy Limited, or any other company trading under the name of Third Energy whose parent company is Third Energy Holdings Limited, registered in the Cayman Islands, may be able to gain future remuneration from depositing or storing any substance, within any expended well-shaft at any of their current or former sites at any time in the future?

Enquiry regarding onshore oil and gas exploration.

 

Thank you for your enquiries which were received on 8, 9 and 11 January
2019.

 

We respond to requests under the Freedom of Information Act 2000 and
Environmental Information Regulations 2004.

 

The Environment Agency only covers regulation of onshore oil and gas
operations for England. You will need to contact the appropriate
environmental regulators for Scotland, Wales and Northern Ireland. We have
responded to the specific questions you ask below.

 

Please note that where we have referred to “Rathlin” this should be taken
to include both Rathlin Energy (UK) Limited and/or Rathlin Energy Limited.
The situation is the same for your enquiries relating to Island Gas and
Third Energy.

 

The Environment Agency is responsible for ensuring operators in England
adhere to the environmental legislation in place. This requires onshore
oil and gas companies to apply for environmental permits to manage any
wastes generated, in some instances this includes reinjection of produced
water which may be authorised if the reinjection is into the same
geological formation from where the produced water originates.
Alternatively, we may allow reinjection to take place if it is into a
formation which has been designated as permanently unsuitable. Third
Energy and IGas have permissions for re-injection wells for produced
water.

 

Please note that spent flowback fluid which arises after repeated use of
hydraulic fracturing fluid during fracking operations is considered an
entirely different waste stream and must be taken off site to an
appropriately permitted waste facility for disposal. However there is no
provision in the permits issued for ‘storage’ of the kind to which you
refer.

 

With regard to the above exploratory drilling companies would you please
respond to the questions below:

 

1. Have Rathlin Energy (UK) Limited or Rathlin Energy Limited ever
deposited for storage any substances within any of their British,
including Northern Ireland, on-shore well-shafts, including all wells that
have been either decommissioned or suspended?

 

To the best of our knowledge no storage of any substances has ever taken
place within any onshore well shaft operated by Rathlin and regulated by
the Environment Agency for the reasons set out above.

 

2. Have Rathlin Energy (UK) Limited or Rathlin Energy Limited ever
received remuneration from depositing or storing any substances within any
of their British, including Northern Ireland, on-shore well-shafts,
including all wells that have been either decommissioned or suspended?

To the best of our knowledge no remuneration has been received by Rathlin
from the deposition or storage of any substances in any onshore well
shafts operated by Rathlin and regulated by the Environment Agency for the
reasons set out above.

 

3. Have Rathlin Energy (UK) Limited or Rathlin Energy Limited ever agreed
to deposit or store any substances within any of their British on-shore
well-shafts, including all wells that have been either decommissioned or
suspended, as any part of a research and development programme?

 

As far as we are aware Rathlin have never agreed to the deposition or
storage of any substances within any onshore well shafts operated by
Rathlin and regulated by the Environment Agency.

 

4. Is their any way possible that Rathlin Energy (UK) Limited or Rathlin
Energy Limited may be able to gain future remuneration from depositing or
storing any substance, within any expended well-shaft at any of their
current or former sites at any time in the future?

 

Not as legislation currently allows. We cannot speculate on whether there
will be any changes to legislation in the future.

Dear Environment Agency,

Please pass this on to the person who conducts Freedom of Information reviews.

I am writing to request an internal review of Environment Agency's handling of my FOI request 'Third Energy Onshore Limited, Kirby Misperton Road, Malton, North Yorkshire YO17 6UR'.

I have received a response to the above Freedom of Information Request, however, the Environment Agency have not responded with any information on Third Energy but have responded citing Rathlin Energy (UK) Limited.

Could you please forward this to the Environment Agency and request they fully investigate my request and don't just conduct a cut and paste excercise.

I would also like to add that given the response to my requests it would seem that no investigations have been conducted just a trite, these are the regulations, response.

This is a serious issue with series implications and should be taken seriously with due investigative dilligence applied to my request.
