I am writing to request information under the Freedom of Information Act 2000. In order to assist you with this request, I am outlining my query as specifically as possible.

Could you please tell me the number of recorded thefts, security breaches/ or incidents (eg. vandalism) at railway stations in your police force area last 12 full months prior to the receipt of this email, specifically between December 2010-November 2011.
I would like a breakdown of incidents which have taken place and where they have happened (specific site addresses). Could you tell me what has been damaged or/ and stolen from the site.
I would like a detailed breakdown of the type of thefts, or incidents which have taken place (either proven or alleged) and any conviction that has taken place (if this is in your ability to expand).
I would be interested in any information held by your organisation regarding my request. I understand that I do not have to specify particular files or documents and that it is the department's responsibility to provide the information I require. If you need further clarification, please contact me by e-mail.

If my request is denied in whole or in part, I ask that you justify all deletions by reference to specific exemptions of the act. I will also expect you to release all non-exempt material. I reserve the right to appeal your decision to withhold any information or to charge excessive fees.
I would be grateful if you could confirm in writing that you have received this request. I look forward to your response within 20 working days, as outlined by the statute.

Your request for information has now been considered. Unfortunately
British Transport Police cannot supply all of the information you
requested for the reasons set out below. This letter acts as a refusal
notice under section 17(5) of the Freedom of Information Act 2000.

 

Section 12 of the FOIA provides an exemption from a public authorityâ s
obligation to comply with a request for information where the cost of
compliance is estimated to exceed the appropriate limit.

 

In relation to your question, information relating to convictions is not
easily retrievable. We conducted a search on our crime recording system
(CRIME) for recorded crimes as per your request. This brought back
approximately 5600 cases. In order to provide the conviction information
for these crimes, we would need to access each case separately on our
Justice Administration System (JAS).

 

It would take approximately 2 minutes per record to retrieve the court
action. Therefore, we estimate that it would take 186 hours to comply with
this part of your request.

 

It is estimated that the cost of providing you with the information is
above the amount to which we are legally required to respond i.e. the cost
of locating and retrieving the information exceeds the â appropriate
levelâ as stated in the Freedom of Information (Fees and Appropriate
Limit) Regulations 2004. In the case of the police service, the
appropriate limit is £450 which has been calculated to equate to a total
of 18 hours of work. If any part of the request exceeds the fees limit
then Section 12 applies to the whole request.

 

 

However, under Section 16 â Duty to provide advice and assistance,
please find attached figures of recorded thefts, security breaches or
incidents at railway stations, minus the conviction information.

 

 

Requesting an internal review.

British Transport Police accept that sometimes an applicant may not agree
with the decision made about their Freedom of Information request. If this
is the case there is a procedure to allow the decision to be reviewed.
