I would be most grateful if you would provide me, under the Freedom of Information Act, details in respect to the contract below.

The details we require are:
• Suppliers who applied for inclusion on each framework/contract and were successful & not successful at the PQQ & ITT stages
• Actual spend on this contract/framework (and any sub lots), from the start of the contract to the current date
• Start date & duration of framework/contract?
• Could you please provide a copy of the service/product specification given to all bidders for when this contract was last advertised?
• Is there an extension clause in the framework(s)/contract(s) and, if so, the duration of the extension?
• Has a decision been made yet on whether the framework(s)/contract(s) are being either extended or renewed?
• Who is the senior officer (outside of procurement) responsible for this contract?

Dear Russell Sneyd,

 

Thank you for your email on 09/07/2021, which included your freedom of
information request asking for tender / contract data in relation to
Health Education England (HEE)

 

In considering a multiple question request section 12 (4) (b) FOIA states
that where multiple requests are received by one public authority, they
can be aggregated for the purposes of calculating costs if they are:

 

 

o By one person, or by different persons who appear to the public
authority to be acting in concert or in pursuance of a campaign;

 

o For the same or similar information; and

 

o The subsequent request is received by the public authority within 60
working days of the previous request.

 

 

 

The intention of this provision is to prevent individuals or organisations
evading the appropriate limit by dividing a request into smaller parts.

 

HEE has estimated that your request would involve reviewing approximately
18 different tendering processes to provide you with the level of detail
and information which you requested.  As a result, HEE feels this would
take us well over the 18-hour limit and would therefore apply Section 12
of the FOI Act to your request.

 

Section 12 provides an exemption from a public authority’s obligation to
comply with a request for information where we estimate the cost of
compliance would exceed the appropriate limit of £450 as set out in the
FOI and Data Protection (Appropriate Limit and Fees) Regulations 2004. The
limit amounts to a maximum of 18 hours of search and retrieval time
charged at £25 per hour.

We have estimated that to locate and collate the information that you have
requested would exceed this limit and therefore under Section 12 of the
Act HEE is not obliged to provide it to you.   

Please contact us if you would like to refine your request and we will
offer advice and assistance under Section 16 of the Act. 

 

Finally, HEE will take no further action in relation to your requests
until we hear from you again.
