The PROCESS required for government executive to repeal legislation, either totally or in part.

We're waiting for Deborah Phillips to read a recent response and update the status.

Deborah Phillips

Dear Law Commission,

I am unable to find information that explains the PROCESS required for government executive to repeal legislation, either totally or in part.

Information is freely available about the process of CREATING legislation, but what I want to know is the process of removing it!

Therefore, under the FOI Act, please would you provide me with your recorded information regarding the process required?

Thank you kindly,

Yours faithfully,

Deborah Phillips

Dear Ms Phillips,

Thank you for your FOI request, which I am handling.

I am writing now to ask you to clarify your request. Our understanding is that you are seeking information explaining the process for the government to repeal legislation.

It is generally the case that the repeal of legislation itself requires legislation. There is information about the legislative process from the government's perspective in the Cabinet Office's Guide to Making Legislation: https://www.gov.uk/government/publicatio... . There is also information about the Parliamentary aspects of the process on the Parliament website (see https://www.parliament.uk/about/how/laws/ ) and in Erskine May, which is now available online (see https://erskinemay.parliament.uk/ ).

So far as the Law Commission is concerned, the need to repeal legislation can in theory arise on any of the Commission's law reform projects. There is also a specific procedure for the repeal of obsolete legislation by means of Statute Law Repeal Acts, and that procedure is the responsibility of the Commission. There is some general information about this procedure on the Commission's website here: https://www.lawcom.gov.uk/our-work/statu... and some more specific information here: https://s3-eu-west-2.amazonaws.com/lawco... .

I should be grateful if you could explain in more detail what information you are seeking so that we may try to identify and locate information held by the Commission that you are seeking. We should make clear that, in providing clarification for us, you are under no obligation to disclose to the Commission the purpose which underlies your request for information.

We should also tell you that whilst we are waiting for you to provide clarification of your request the 20 working days' time limit for our responding to you on the request will not operate.

If you need to discuss this issue, or need assistance in identifying more clearly the information you are seeking, please contact me using the details given below.
