The legal advice provided to the PM relating to his recent decision to prorogue Parliament for so long

I request all information held by Cabinet Office relating to the PM's recent decision to prorogue Parliament including all related legal advice.

The public interest in disclosure in this instance is extremely strong in light of today's unanimous Supreme Court judgement.

The public is entitled to know whether the PM ignored or overrode his own legal advisors.

I am writing to request an internal review of Cabinet Office's handling of my FOI request 'The legal advice provided to the PM relating to his recent decision to prorogue Parliament for so long'.

I do not accept your reasons for withholding information relating to policy and legal advice.

The relevant policy is now settled given that the Supreme Court unanimously disagreed with the government’s decision to prorogue. That policy is no longer “live” so the public interest in maintaining the policy exemption no longer outweighs the public interest in maintaining the exemption. Please revisit your decision.

I also disagree with your application of the legal advice exemption. The government’s decision to prorogue for so long served to thwart the role/will of Parliament at a very significant moment in the Nation’s history.

It was a political act and the public is entitled to know if the government chose to ignore its own law officers advice. In these most exceptional circumstances I consider that the strong public interest in maintaining the confidentiality between client and lawyer is significantly diluted in this extraordinary case such that it no longer outweighs the public interest in maintaining this exemption.
