Thank you for your request for information of 6th of April 2018 which has
been logged as 4801623. We confirm that your request has been dealt with
under the Environmental Information Regulations 2004. 

 

The FOIA provides that environmental information is an absolute exemption
(section 39(1)) and therefore requests for environmental information must
be dealt with under the EIR.

 

The EIR defines environmental information as being any information in
written, visual, aural, electronic or any material form on- 

 

            2(1) (a) the state of the elements of the environment, such as
air and atmosphere,  water, soil, land, landscape and natural sites
including wetlands, coastal and marine areas, biological diversity and its
components, including genetically modified organisms, and the interaction
among these elements;

           

2(1)(b) factors such as substances, energy, noise, radiation or waste,
including radioactive waste, emissions, discharges and other releases into
the environment, affecting or likely to affect the elements of the
environment referred to in (a);

 

2(1)( c ) measures (including administrative measures)such as policies,
legislation, plans, programmes, environmental agreements, and activities
affecting or likely to affect the elements and factors referred to in (a)
and (b) as well as measures or activities designed to protect those
elements;

 

2(1) (d) reports on the implementation of environmental legislation;

 

2(1) (e) cost-benefit and other economic analyses and assumptions used
within the framework of the measures and activities referred to in (c);

 

2(1) (f) the state of human health and safety, including the contamination
of the food chain, where relevant, conditions of human life, cultural
sites and built structures inasmuch as they are or may be affected by the
state of the elements of the environment referred to in (a) or, through
those elements by any, matters referred to in (b) and (c).

 

The request therefore falls to be considered within Regulation 2 (1) (a)
(b) and (c) of the EIR as the information requested concerns the state of
land and administrative plans for the use of land.

 

For the purposes of clarity your request is reproduced below with
response.

 

As a Parish Councillor I am often asked why our roads are in such bad
state of repair and I would wish to be able to know the amounts of money
spent, the frequency and the numbers of road maintenance actions taken by
Parish across Cheshire West and Cheshire during the financial year
2017-2018.

 

Please find attached the data requested for the number of road maintenance
actions by parish. Please note we have provided the ‘number of jobs’ for
maintenance works for each parish across Cheshire West & Chester. We are
unclear what is meant by ‘frequency’ of repairs, as this information is
provided within ‘number of jobs’ carried out. If this does not answer your
query regarding ‘frequency’ we would please ask you to submit what
information in relation to this part of your request you are requiring.  

 

Please also note, some of the data has no monetary value against the
‘number of jobs’. This is because the payment for these jobs is from a
central order for the crew which works over a number of parishes/areas and
we are unable to associate the costs of the individual repairs. The
completed values by parish also contain the costs for any resurfacing
treatments by parish.
