Thanet Kent Contaminated land and hazards to health

The request was refused by Environment Agency.

Dear Environment Agency,

(1) Will you disclose whether Queen Elizabeth Queen Mother site Margate is niw or was a contaminated designation site. If so why

(2) Is Thor Chemicals a contaminated site close to QEQM Hospital given its remediation project is ongoing and last time of checking has still not begun ground mercury remediation

(3) Working away from QEQM why is the former GEC Transformer site not a contaminated land site given reports of burials of toxic transformer oil behind the factory (Now under Westwood Retail parks) have been made to Thanet District Council starting in 1980s when supported by inclusion in a TV news bulletin.

(4) The reports at (3) extended to burial of toxic transformer oils at Pegwell Land fill now Nature Reserve. Your records should show that PCBs were found at surface at Pegwell Nature Reserve 1992 at 1.88 times cancer causing threshold Have any tests been conducted to identify source of PCBs given the likelihood of deteriorating drums of transformer oil ?

(5) Building on your helpful 2008 reply to FOI re Sericol Broadstairs leak of hundreds of tonnes of cyclohexanone to water supply aquifer. Now that National Planning for Manston has received a change of position from Thanet District Council Now reviewing contaminated land strategy and acknowledging there must be tests for toxic residue of firefighting foam accessing Thanet water supply via adit and aquifer for "Lord of the Manor " Abstraction from Manston aquifer This is close to the Pegwell site mentioned above re PCBs. Pegwell is a second fast track contamination route from Manston to sea via outfall.

The requirement to estimate total toxic load inputted is self evident. How much firefighting foam was used at Manston. How much cyclohexanone went missing at Sericol now they must be in position to audit production requirements to assess the leak loss.

How much transformer oil was buried by GEC ? They were refurbishing old transformers all the time That is a lot of old oil drained Plus they had a new product recall for defective welds failing and thus leaking insulating cooling oil

At each of these Four sites GEC/Pegwell, Sericol, Manston that toxic load measures in the 1000s of tonnes. Clearly if tests at Manston say all is clear Hrrah the question remains where did the tonnage of firefighting foam go ? And the answer seems to be it relocated to human bodies in the water and to food chain farming and fishing ?

We have considered your request under the provisions of the Freedom of
Information Act 2000 / Environmental Information Regulations 2004 (EIR).
The Act requires that we respond to requests by advising you whether or
not information is held, and if so by providing you with that information.

EIR Regulation 3(2) states that information is held if it is in our
possession and has been produced or received by us, or it is held by
another person on our behalf at the time the request is received.

 

Information not held

In this case, the information you have requested is not held by the
Environment Agency, and we are therefore refusing your request on the
grounds that there is no information we can provide.

 

Where a request is for environmental information, the Regulations allow us
to refuse to disclose it if the exception at EIR Regulation 12(4)(a)
applies. The regulation states that a public authority may refuse to
disclose environmental information to the extent that it does not hold
that information when an applicant’s request is received.

 

It is not possible for us to conduct a public interest balancing test
because the reason for non-disclosure is that the information is not held.

provided the answers to these questions under the following reference

Under Regulation 12(4)(b) of the Environmental Information Regulations
2004, a public authority can refuse to fulfil a request for information if
the question has been answered previously, as it is manifestly
unreasonable to answer the same or substantially similar question
repeatedly.

 

As a public body we are required under the Environmental Information
Regulations 2004 to give reasons for this refusal. We also need to show
that we have considered the Public Interest balance between refusal and
disclosure. Please see appendix for further details.

 

If you are not satisfied you can contact us within two calendar months to
ask for our decision to be reviewed. We shall review our response to your
request and give you our decision in writing within 40 working days.

If you are still not satisfied following this, you can raise a concern
with the Information Commissioner, who is the statutory regulator for

Appendix

 

Relevant exceptions

The exceptions that apply to the withheld information are: 12(4) A public
authority may refuse to disclose information to the extent that – (b) the
request for information is manifestly unreasonable.

 

The Public Interest Test

When an authority refuses a request for environmental information it must
consider whether the public interest is better served by supplying the
information or by maintaining the exemption. In making the decision that
there is nothing further we can add, we have taken into account various
factors.

 

We have considered the factors in favour of providing the requested
information. We believe that there is a general presumption of openness.
The Environment Agency would only withhold information if it is sure that
disclosure would cause substantial harm. Here the harm is that giving
further time and other resources to your repeated communications on this
issue would divert these resources from our primary regulatory
responsibilities. We believe that there is a general need to ensure that
public authorities are accountable and transparent. It is important that
the public should be able to review the decisions taken by public
authorities and understand how these decisions have been reached. However,
in this instance, we believe that we are not obliged to continue releasing
the same or substantially similar information which we have already sent
to you.

In this particular case the factors in favour of refusal are weighty. We
believe that we have answered your requests as far as we are able to.
Continuing to correspond with you on this issue does not benefit society
at large by contributing to the effective running of the public sector, in
fact quite the contrary; dealing with repeated communications about this
issue is a distraction from our primary regulatory responsibilities.

 

After detailed consideration, we are not prepared to continue to
correspond with you on these issues.

 

As indicated, upon assessing the factors in the public interest test, we
conclude that in relation to the applicable exception, we find that the
factors in favour of withholding information outweigh the public interest
factors in disclosing the information.

The situation is I had a stroke last September which stopped me going for judicial review of Thanet District Council to seek mandamus of compliance with statutory duties under Environmental Protection Act 1990

Flowing from that as you know further statutory duties re cumulative impact and precautionary principle. And further statutory duties to report environmental hazards to health to NHS via Public Health and via Clinical Commissioning Groups.

When I emerged from hospital your department had emailed that tests are scheduled for Manston. And that neither use for Manston (Neither aviation nor housing) was approved,

TDC then slipped a change of position under the radar to the National Planning process re Manston. Saying they must and will conduct a review of their contaminated land strategy. In reality IMO that must be a review into a blank contaminated land register and a b;ank sheet under heading "Strategy"

Nonetheless TDC is reviewing.

Then the local plan inspector seemed to cotton on to the problem and has called for reports from Southern Water and from TDC about water supply safety.

Thanet has not had safe water for 56 years so far and counting. If we include the Sericol history which so far has not been amended to account for the nearby GEC Polychlorinated bi phenyl toxic burials history

In this meantime Southern Water after a four months delay decided to disclose by FOI that they aint tested the water supply abstracted from the Manston aquifer. They have no record for testing it in the past ten years for PFOA etc.

Then May as you know (while TDC is deliberating about what to tell Local Inspector and whether to employ a fiction writer in that regard. Their problem being how to come up with a story that satisfies Sec of State for Health, National Planning Manston and Local Plan Inspector all at the same time.

Then as you know the Stockholm Convention classified PFOA

I imagine this following helpful comment will act as an analogy. TDC is like an Orange Order Band. Marching vigorously lot of ooompah boom boom boom but somehow staying on same spot.

So a fast changing situation TDC will give every impression they are keeping up with is actually being ignored while they blow their own trumpets and mark time on the spot.

On this occasion they have thrown in sleight of hand which after years of describing an FOI applicant (Not me) as "Vexatious" for asking .. TDC is opening its accounts for Ramsgate port After sufficient time for the tippex fumes to dissipate. It could be that TDC have spotted that the PFOA classification could be a problem re Brett planning consent and current millions of hidden subsidy public grant to build further process based on past questionable planning consent I dunno how much public water Brett uses for its concrete works. But you do ? And now you know about PFOA classification.

I hope this provides context and essential information for you as you are my most favoured and top answerers of FOIs.

Dear KSL Enquiries,

I called in DEFRA Drinking Water Inspectorate who consequently banned Southern Water from using Manston aquifer as a Thanet water supply source until and unless Southern water can show tests which meet wholesome water requirements.

I think you had a duty under Stockholm Convention for all the years PFOA was on annex B ? But now it is upgraded to Annex A as I wrote above.
