TfL Rail Contract with MTR

We're waiting for Howard Tang to read a recent response and update the status.

Dear Transport for London,

I would like to receive a copy of the contract between TfL and MTR Corporation for the operation of TfL Rail.

I would also like to know if there are further plans to award any contracts to the MTR Corporation, or if the MTR Corporation has indicated interest in bidding for any part of TfL's service.

Your request has been considered in accordance with the requirements of

In accordance with section 21 of the FOI Act, we are not obliged to supply
you with a copy of the requested information as it is already accessible
to you elsewhere.

 

I would also like to know if there are further plans to award any
contracts to the MTR Corporation, or if the MTR Corporation has indicated
interest in bidding for any part of TfL's service.

 

In accordance with the FOI Act, we are not obliged to disclose financial
information relating to MTR Corporation as it is subject to a statutory
exemption to the right of access to information under section 43(2).

 

In this instance the exemption has been applied as disclosure of the
information you have requested would be likely to prejudice our commercial
interests. Disclosing financial information would be likely to prejudice
our commercial interests as it would be likely to adversely affect the
amount we obtain through our future negotiations with commercial partners.

 

The use of this exemption is subject to an assessment of the public
interest in relation to the disclosure of the information concerned. TfL
recognises the need for openness and transparency by public authorities,
particularly where the use of public assets, but in this instance the
public interest in ensuring that TfL is able to obtain the best value from
public assets, outweighs the general public interest in increasing
transparency of TfL’s processes.
