Provision of information held by Northumbria Police made under the Freedom
of Information Act 2000 (the 'Act')

Thank you for your email dated 21 July 2011 in which you made a request for
access to certain information which may be held by Northumbria Police.

As you may be aware the purpose of the Act is to allow a general right of
access to information held by a Public Authority (including the Police),
subject to certain limitations and exemptions.

You asked:

Has any act of terrorism by a terrorist organisation, or person\persons
acting on behalf of such an organisation been perpertrated within your
force area over the period of the last 15 years.
I mean 'any offence under the terrorism act' referring to the 'shooting'
(Where a 9mm handgun was used) of civilians or Police Officers over the
last 15 years

In response:

We have now had the opportunity to fully consider your request and I
provide a response for your attention.

Your request is clearly linked to the subject of the shooting of Martin
McGartland. As a member of his campaign group you are fully aware that it
is in the public domain that Mr McGartland was the victim of a shooting. It
has also been stated in various media articles that Mr McGartland was shot
by a 9mm gun.

As you have previously been informed, the subject of Martin McGartland's
shooting has been declared vexatious under section 14 of the Act. You are
also already aware that any request relating to the subsequent
investigation into that shooting can fairly be classed as vexatious. As
your request is clearly on this subject, that notice is applicable to your
latest request.

Case law states that "In most cases the vexatious nature of a request will
only emerge after considering the request in its context and background.
As part of that context, the identity of the requester and past dealings
with the public authority can be taken in to account.’ (Mr J Welsh v the
Information Commissioner).

Please note a public authority is not obliged to comply with a request for
information if the request is deemed as vexatious.

You should note that following this correspondence, we are not obliged to,
nor do we intend to, take any further steps in relation to this matter or
any further requests that you may submit that are deemed to fall into the
remit of vexatious.

How to complain

If you are unhappy with our decision or do not consider that we have
handled your request properly and we are unable to resolve this issue
informally, you are entitled to make a formal complaint to us under our
complaints procedure which is attached.

If you are still unhappy after we have investigated your complaint and
reported to you the outcome, you may complain directly to the Information
Commissioner’s Office and request that they investigate to ascertain
whether we have dealt with your request in accordance with the Act.
