Dear Yorkshire Housing,

Dear Mr Jones,

Tenancies unfit for human habitation.

Sunnyside, East Ardsley, Wakefield, including but not limited to WF3 2JR

The tolerable standard is a "condemnatory" standard; a house that falls below it is not acceptable as living accommodation.

Local authorities Social Housing providers have a statutory duty and specific powers to deal with houses that fall below the tolerable standard
(" BTS").

The Housing Corporation requires housing associations to be accessible, accountable and transparent to residents and other stakeholders.

The National Housing Federation Code of Governance states that associations should operate in an open and accountable manner by generally making information about their work available to their residents, local communities and other stakeholders.

Therefore please advise the following:

Year on year since January 2008, please advise the total number of call outs, requests & complaints you have received from residents in regard to damp and mould at Sunnyfield, East Ardsley, Wakefield, including but not limited to postcode WF3 2JR.

Please supply a copy of your policy and procedures in relation to the bedroom tax and how an individual with a protected characteristic under the Equalities Act 2010, would be effected by your association's policy and procedure.

Please advise the date of the implementation of this policy and furnish me with all amendments including dates of said amendments. Please advise if you consider the growth of mushrooms in your property to be an acceptable standard of living for any one, but more importantly a person with a disability-a protected characteristic under the Equalities Act 2010.

Please furnish me with any relevant paperwork and inspection of housing that adheres to the convention of human rights, to be expected to live in conditions fit for mushroom growth.

I trust you will take this matter very seriously and furnish me with the information I requested within the statutory timescale.

Thank you for your email sent on 3 February regarding Freedom of
Information Request.

 

The Freedom of Information legislation does not apply to housing
associations so the timescales do not apply to Yorkshire Housing. We are
unable to give any information about property maintenance records unless
the request comes from a customer. In relation to your Bedroom Tax
enquiry, the legislation was implemented by Central Government and is
administered by Local Authorities.  If further information is required
about the assessment and implementation of Bedroom Tax contact should be
made with the Local Authority.

Thank you for your response, you are the first person within your organisation I have actually had a substantial response from, for that I am exceptionally grateful.

However in response I note that you stated “The Freedom of Information legislation does not apply to housing
associations so the timescales do not apply to Yorkshire Housing.“ however, is it not the case that Yorkshire Housing is subject to EIRS the Environment Information Regulations which is embedded within FOIA.

As this request is intrinsically linked to the environment with natural growing orgamisms in your housing stock, if you will not consider this request under EiR’s, I shall only take this aspect of the request to the ICO for appeal, and have to follow due diligence and procedure to do so hence I had to request an internal review.

As you are most likely aware, and fortunately for myself, I am the cousin of one your tenants, and not one of your tenants. Therefore I shall arrange to have your tenent request the information you have said that only tenants can Requested,

With out ill will malice or vexation, I ask a simple question, if you were to anwer this without evasion, the reputation of Yorkshire Housing may increase in my view, now the decision whether to answer this question say “as a gesture of professionsl good will” will lie at your door, however I have always been of the opinion, there is no point in pretending there is no issue, and I offer Nr Jones of Y Housing an opportunity to dialogue with my self as an Advocate for your tenant, whereby I am sure if Mr Jones is willing to meet in the middle, conciliation can be easily achieved and bring a mutually beneficial outcome for both Housing Association and Tenant alike.

The question relates to the bedroom tax policy, can you confirm if you have received guidance on implementation of the bedroom tax from your local councils?

I most encourage Mr Jones to accept my invitation to discusd the pressing issues at hand, to ensure a swifty resolove for both sides, with minimal fuss.
