Swansea Bay Racial Equality Council: influence or directing of child protection, social services inquiries and family court proceedings.

Dear Swansea Council,

According to communication between a social worker and the director of the Swansea Bay Racial Equality Council [SBREC] it was stated that the social worker had supported the Mother by writing a s.7 [welfare] report for the courts and advising her of the court process - in private law/residence/contact proceedings.

This seemingly partial and improper support was given, due it appears to pressure and support from the SBREC, following allegations made by the Mother against the father and her then being found to have locked the children home alone [on more than one occasion]. The Mother’s solicitor had legal aid and was in position to provide any advice in private law proceedings, not social services.

Please provide a copy of the policy or guidance in such cases

1. For providing support in private law proceedings including writing [favourable] s.7 reports - where pressures are brought to bear by support groups and/or ethnic/minority support groups [such as the SBREC] by their demanding support from social/child protection services.

2. Providing support to the Mother [supported by groups] whilst not informing the father of concerns for the children raised by third parties.

3. Withholding disclosure or otherwise assisting the Mother [supported by groups] by “grooming” the evidence from social work files.

The council's procedures were requested. From the information provided to the request the Council did not follow the statutory guidance not least by failing to be impartial.

Thanks for your response.

However, the social worker did state to a lobbying group [here Swansea Bay Racial equality Council]

""_The support I have offered is to undertake a section 7 welfare report for the courts and also to give the Mother support through the court process and contact issues regarding her children -""

If she breached the statutory guidance and was unfair to a parent then she is a risk to children/children's welfare and in breach of section 1 of the Children's Act 1989.

However, if Swansea Council have a policy/guidance of writing s.7 reports whilst supporting one parent and having a conflict of interest in private law proceedings then that must be provided.

I can categorically state that no such policy or guidance exists and have on two occasions now provided you with the guidance used by Swansea Council Social Services in this matter. If you think that Social Services officers failed to follow that guidance in your case, there is a process for making a complaint which can be found at http://www.swansea.gov.uk/sscomplaints
