Survey of cyclist road type preferences
Dear Transport for London,
The recently published fifth Travel in London report describes (on page 122) the results of a survey of cyclists in London which found that "cyclists were willing to increase their journey time to travel on better, safer routes. Current London cyclists are prepared to travel further to cycle in cycle lanes, bus lanes, on residential roads and would travel three times further to cycle on off-road routes."
I would be grateful if you could send me the results of this survey and any associated summary reports.
Yours faithfully,
Jim Gleeson

Dear FOI,
Rather than let this go on indefinitely, can you please give me a firm date, preferably this week, by which you will respond? I can't see why it should be taking so long, since you have already published a summary of the information.
Yours sincerely,
Jim Gleeson
Dear Mr Gleeson

Dear Transport for London,
Please pass this on to the person who conducts Freedom of Information reviews.
I am writing to request an internal review of Transport for London's handling of my FOI request 'Survey of cyclist road type preferences'.
I submitted this request on the 1st of January, nearly three months ago. The deadline of 31 January passed without any response or explanation of the delay, as did the next deadline proposed by TfL (8 February). On 12 February I was told that I would be sent the information as soon as the relevant business area collated it, but no explanation was given as to why this had not already happened. On 25 February I sent a reminder message, which more than a week later (6 March) received another response simply noting that the relevant team within TfL had failed to produce the relevant information. Having not heard anything back in the weeks since I see no alternative but to request an internal review.
As noted in my correspondence, TfL clearly hold this information as they have already published a summary of it. TfL's failure to provide either the information requested or an adequate explanation for the repeated delays is very disappointing.
A full history of my FOI request and all correspondence is available on the Internet at this address:

Every effort will be made to provide you with a response by 24 April 2013.
However, if the review will not be completed by this date, we will contact
you and notify you of the revised response date as soon as possible.
In the meantime, if you would like to discuss this matter further, please
do not hesitate to contact me.

E-mail: [TfL request email]
Dear TfL,
On 25 March you told me that I would receive a response to my internal review request by 24 April, and added: "if the review will not be completed by this date, we will contact you and notify you of the revised response date as soon as possible."
As of today, the 1st of May, you have neither responded nor notified me of any reason for delay or a revised response rate. I would appreciate it if you could tell me why this latest delay has occurred and when you will finally respond.
Yours sincerely,
Jim Gleeson
Dear TfL,
Due to the continuing lack of response to either my original request or the request for an internal review, I have now made a complaint regarding this case to the Information Commissioner's Office.

Subject: Internal Review of FOI Request
Dear Mr Gleeson
I am writing in response to your request for an internal review of the
handling of your request for the results of a survey referred to in the
fifth Travel in London report. The cycle route choice survey was sent to
you on the 13 June 2013. Please accept my sincere apologies for the delay
in responding.
It is clear that, in failing to provide you with a valid response within
20 working days, TfL is in breach of section 10(1) of the FOI Act. I can
inform you that the main components of the delay were some staffing
changes within the business area of TfL that held the requested
information, and also a failure within the FOI team to prioritise requests
which have missed the 20 day response target. The staffing changes in the
business area were a temporary impediment to resolving your request which
have now been overcome. I have introduced a new monitoring regime to track
and report on requests that have missed the 20 day response target and
this regime is now reflected in the teams annual performance reviews. On
behalf of TfL I apologise for the delay that you experienced and for any
frustration and inconvenience this may have caused.
In view of these failings, we do not consider that this necessarily
represents the end of the internal review process. We consider that it
would not be fair to you to deny you the opportunity for an internal
review of the quality of the response simply because you have already
exercised your right to a review in view of our failure to provide a
timely response. As noted above a response has been provided since you
made your original request for an internal review, so if you are not
satisfied with the quality of the response, you may still request a
further internal review.
However, if you are dissatisfied with the internal review actions to date
you can refer the matter to the independent authority responsible for
enforcing the Freedom of Information Act, at the following address:
Information Commissioner’s Office
Wycliffe House
Water Lane
Wilmslow
Cheshire SK9 5AF
A complaint form is also available on the ICO’s website

Yours Sincerely
