Q1 How do you arrange supportive care for both the Adults in Care and their families?

A1 Under the law, all people are able to ask for and receive a community care assessment. If the community care assessment results in the eligibility criteria being met then that care is offered to the customer. Therefore once assessed as meeting the criteria set by the Council they are offered a care service.

Q2 How much does LBB charge the families to provide such support on an hourly rate?

A2 The council's charging policy is attached

Q3 Is any care provided free of charge, and if so, what?

A3 The council's charging policy (attached) details those services provided without charge

Q4 What enhanced CRB checks are made by LBB of any and all support workers providing such support to adults and their families?

A4 All social care workers employed by Bromley have been subject to appropriate CRB checks. All private and voluntary organisations providing care on behalf of LBB are also required to CRB check their staff where appropriate.

I am writing to request an internal review of Bromley Borough Council's handling of my FOI request 'Support for adults in care and their families in London Borough of Bromley'.

SUPPORT FOR ADULTS IN CARE AND THEIR FAMILIES IN LONDON BOROUGH OF BROMLEY

How do you arrange supportive care for both the Adults in Care and their families?

I thank you for responding to me and I am very grateful to receive SOME of the data I requested. You explained the CRB checks - but what about the AMHPs [are these Government Bodies/Agencies?] that you employ?

Mental Health legislation is performed on behalf of LBB via AHMPs and Social Workers are they not?

And of course this relates specifically to "support for adults in care and their families in London Borough of Bromley"

And the agency workers who might perform individual services on a "one-off" basis?

Again I find that there is not much about the aftercare provision for people who might be on a Community Treatment Order or be subject to a Section 117[?] or any other section of the 1983/2007 MHA Act. I note that there was a major court action brought against London Borough of Bromley regarding aftercare from Mental Health and therefore I specifically wish to know how London Borough of Bromley has SINCE that time made policies and implemented them.

I feel that this is an important aspect of supporting both the Adults in Care and their families for it is not just a question of putting someone into care, whether it be in a mental health facility via a Section 2 or 3 or via a Section 135, but also for Guardianship and decisions made on behalf of LBB by AMHPs and Responsible Clinicians with the approval and acceptance by LBB itself.

Therefore I am asking how you provide checks and balances so that if the people who are determining where a person goes after being an inpatient of a mental facility on a Section of the MHA 1983/2007 THEN FREE CARE is provided as by law.

But how do you ensure that there is not any indirect financial imperative to push for a person to be deemed to be lacking capacity so that they come under the MCA 2005 instead of the MHA 1983/2007?

And at one and the same time of course be removed from MHA 1983/2007 which the AMHP can recommend to the Hospital Managers but if these Hospital Managers of a mental health trust?

If this mental health trust is also employing the same AMHP as a Care Manager, is there not POTENTIALLY an APPARENT [even if not real] lack of transparency?

Could not someone see this, perhaps, as a means to an end of cutting back expensive accommodation for aftercare provision on MHA 1983/2007?

For if a person leaves the facility NOT on MHA but as being under Guardianship control of the LBB, and UNDER MCA 2005, then the person will be liable for payment to LBB for provision of accommodation using their savings or perhaps an inheritance?

This is what I specifically want to be addressed please as there are now many instances of the MCA2005 - and in particular Section 44 being used - allegedly unwisely - and that the Law is very uncertain on this. I understand this is being debated in other fora nationally.

Is any care provided free of charge, and if so, what to people who have been made under Guardianship of the London Borough of Bromley OR their partners - such as of Oxleas Mental Health NHS Foundation Trust?

Dear Mr Patterson CEO London Borough of Bromley, Ms Coulston Information Access and Data Controller London Borough of Bromley, Mr Turner MP for the Isle of Wight, Mr Pickles Secretary of State for Communities and Local Government, Information Officer,

I am requesting that the Information Officer liaise with London Borough of Bromley in respect of my request for Internal Review of my requests for information under the Freedom of Information Act 2000:
'Support for adults in care and their families in London Borough of Bromley'.

I was very thankful to Ms Coulston for her initial response with the data, notwithstanding that it did take more than the standard 20 working days to get me the information. I waited patiently.

What perplexes me is that I placed a request for Internal Review with London Borough of Bromley over 2 months ago and despite receiving acknowledgements, have NOT received any actual response to my requests for internal review.

That is why I am asking now for the Information Officer to investigate this with Ms Coulston and London Borough of Bromley in the hope and expectation that they can resolve this speedily. I do have faith in Ms Coulston and just wish to have this data.
