Supply of Office Stationery

We're waiting for Owen Smith to read recent responses and update the status.

Dear FOI Team,

I would be most grateful if you would provide me, under the Freedom of Information Act, details in respect to the contract below.

Supply of Office Stationery

The details we require are:

• Suppliers who applied for inclusion on each framework/contract and were successful & not successful at the PQQ & ITT stages
• Actual contract values of each framework/contract (& any sub lots)
• Start date & duration of framework
• Is there an extension clause in the framework(s)/contract(s) and, if so, the duration of the extension?
• Has a decision been made yet on whether the framework(s)/contract(s) are being either extended or renewed?
• Who is the senior officer (outside of procurement) responsible for this contract?

Thank you for your help.

Yours sincerely

In accordance with the Act, this email also acts as a Refusal Notice and
details of the exemption applied is as follows:

Exemption under section

S43 – Commercial Interests

Information the exemption applied to

Questions 1 (a)

Reason for applying the exemption

Section 43 (2) Commercial Interests

Information relating to the unsuccessful bidders for the contract is
considered exempt. This is because disclosure under the ‘Act’ would,

or would be likely to prejudice the commercial interests of any person
(including the public authority holding it).

Public Interest Test

The Council recognises the need for transparency; however, this must be
balanced against the public interest in allowing the organisation and
third parties to protect their commercial information, and not be placed
at a disadvantage in the competitive market place in which we operate.
Section 43(2) is a prejudice-based exemption, and there is a public
interest inherent in avoiding the harm specified.  In this case, the
Council considers that the prejudice would be likely to occur.  Having
considered the above, we are satisfied that the public interest in
maintaining the exemption outweighs the public interest in disclosures to
engage in commercial activities with us. The release of this information
may jeopardise this commercial confidence. On balance the public interest
weighs in favour of the exemption.

I trust the information is of use to you and will close your request.
