I appreciate your recent response to my request. Please pass this on to the person who conducts Freedom of Information reviews.

I am writing to politely request an internal review of the handling of my FOI request 'Subsidy Control consultation'. In particular I do not think that the application of section 35 of the FOI Act has been carried out in a manner that is compliant with public law.

I acknowledge that policy is still being decided. The issue I have is in terms of the rationale then applied.

In particular there is no strong reason to believe disclosure could harm the policy making process. Indeed on the face of it, the alternative is true, Parliamentary scrutiny benefits from the release of such information.

After all, the Minister has already set out their initial view in the consultation document and supplemented this in the Queen’s Speech. The Minister has access to the consultation responses which it can use to make its own assessment. Disclosure would not change that.

However MPs and the Lords are being denied such information. The reasonable conclusion is that non-disclosure will damage and distort the Parliamentary process by not allowing MPs and Lords to have access to the full information. It follows that if MPs and Lords should be allowed access, so should the public.

More broadly the assumption seems to be that a Minister can’t change their mind if a consultation response is public. How could that be the case?

Finally there seems to be an assumption in the response that the consultation was somehow secret. That is not the case. The consultation did not state this and, of course, other responses are published.
