Dear Ministry of Defence,

Bellow is a copy of a Subject Access Request submitted to the MoD:-
---------------------------------------

Subject to the Data Protection Act 1998, can I request all my personal data that falls within the scope of the act in relation to my allegation of RAF police interview tape editing, malice prosecution and summary hearings not being Article 6 of the Human Rights Act or Military covenant compliment including but not limited to:-

1) Any minutes of meetings, recorded information, documents, correspondence, emails or marginal notes containing my personal data, as to why a similar subject access request for personal data was refused, considered a Freedom of information request
(18-10-2012-141202-001) and subsequently refused under section 12.

2) Any minutes of meetings, recorded information, documents, correspondence, emails or marginal notes containing my personal data, between HQ Air Command and the RAF police.

3)Any minutes of meetings, recorded information, documents, correspondence, emails or marginal notes containing my personal data, between the Commanding Officer RAF Kinloss and Regional Legal Office (Northern).

4)Any minutes of meetings, recorded information, documents, correspondence, emails, marginal notes, or pages from journals and logs containing my personal data held at the Service Police Crime Bureau.

5)Any minutes of meetings, recorded information, documents, correspondence, emails, marginal notes, or pages from journals and logs containing my personal data held at Regional Legal Office (Northern)

6)All witness statements, charge paperwork, documents and recorded information generated at all stages of my arrest by RAF Police and subsistent summary hearing conviction.

7) A copy of all data held that constitutes my criminal conviction (if the MoD still insist I have one).

8) Any minutes of meetings, recorded information, documents, correspondence, emails or marginal notes as to how Sailors, Soldiers, and Airmen such as myself can have criminal convictions without any knowledge of having them?

---------------------------------------

Can I request under the Freedom of Information Act 2000:-

1)Can I request a copy of an acknowledgment letter that this and the previous Subject Access Request will be considered under the DPA 98, and not the Freedom of Information Act 2000?

2)Any policy or guidelines that the MoD hold on what constitutes personal data that differ from The data protection act http://www.legislation.gov.uk/ukpga/1998...

2) I previously requested "All correspondence, minutes, marginal notes, emails, memos and
relevant documents pertaining to my allegation of Royal Air Force
Police interview tape editing and the statutory basis of criminal
proceedings at Summary Hearings prior to the Armed Forces Act 2006.
Including but not limited to any meetings or decisions not to
acknowledge or reply that resulted from;
My email to Greg Clark MP 06/10/12
My email to Andrew Robathan 03/10/12
Email to MOD via “Ask a Minister” 30/08/12
Open email to Greg Clark MP 27/04/12
My email to Matthew Dickins (office of Greg Clark MP) 24/08/2012,
07/08/2012, 31/07/2012 and 18/07/2012.
Letter to SIB (Army) 26/09/12
Anything written or electronic with the references;
PM(RAF)1501/10/POL, Air/CmdSec/BusSec/M&C/Parl/TOC/2012 and
24-08-2012-124804-002"

2)Can I request any recorded information that explain the perplexing state that my Subject Access Request has been refused?
I am the data subject requesting my personal data, and the MoD are failing to comply with the law. Can I request an independent body reexamine my subject access request, and consider that my allegation of criminal misconduct (editing interview tapes) also be examined?

Yours faithfully,
