Please note that the University has been receiving legal advice and
guidance relation to compliance with the Office for Students guidance. The
information requested therefore is exempt under section 42(1) of the
Freedom of Information Act 2000 and is therefore being withheld. The
information requested constitutes legal advice and having considered the
public interest, the University's decision is to withhold the information
under legal professional privilege (LPP). Section 42 provides an exemption
under the Freedom of Information Act for information protected by legal
professional privilege.

Further to your e-mail dated 12 April 2021, requesting an internal review
of our response to your request under Freedom of Information Act (the Act)
dated 30 March 2021, please find below my response on behalf of the
University of Huddersfield (“the University”).

 

 1. Review Process

In conducting this internal review, I have reviewed carefully your request
and the University’s response, which are summarised below:

•           Your initial Freedom of Information request dated 3 March 2021
and our response dated 30 March 2021.

•           Your e-mail dated 12 April 2021 requesting a review of the
University’s handling of your request.

 

 2. Response

The University’s previous response explained that the University had been
receiving legal advice and guidance in relation to compliance with the
Office for Students guidance and refused your request using the exemption
under section 42(1) of the Freedom of Information Act 2000.

 

Our previous response also referred you to the University’s website about
the general procedure in relation to changes to the material information
for students.

 

 3. Outcome of Internal Review

In addition to our previous response, I can confirm that the University
published updated information on its website for all students that
explained the University’s planned approach to delivery of the courses
commencing or continuing in the academic year 2020/21. The University
contacted the students to explain the above and how to access the further
information. 

 

When considering the application of the Section 42 exemption I took into
account the following factors:

o The concept of legal professional privilege and the rationale behind
the concept, and
o The nature of the legal advice provided to a very current and live
matter.

 

Having reviewed the above, against the factors in favour of disclosure
i.e. accountability and transparency, I do not consider that the public
interest in disclosure would outweigh the importance of maintaining the
privilege of the review. I therefore consider that the Section 42 was
applied appropriately.
