Dear Harvey,

Further to your recent request for information, the University’s response
follows.

1. Please explain the steps that the university took last summer, prior to
the main autumn enrolment period, to comply with Paragraphs 39, 45, 46,
and 52 of the following Office for Students guidance, with particular
reference to obtaining consent from students for changes to the material
information.
[1]https://www.officeforstudents.org.uk/med...

In order to meet the OfS guidance relating to meeting CMA requirements,
we added changes to the information on each of our course pages on the
website.  This information was uploaded before Clearing;  prospective
students were informed via email before the UCAS embargo that this
information was being uploaded and then they were emailed again after the
embargo to inform them that the changes information was now available on
the course pages.  Students were advised to read the information made
available, as they would be required to confirm that they have read and
understood the changes and agree to them as part of the online enrolment
process.  In order to get students’ express consent on the changes, the
enrolment process required students to confirm their acceptance by ticking
a box on the form.

Changes to courses impacting current students were communicated via course
handbooks.  The handbooks were updated before students re-enrolled and
students were required at re-enrolment to confirm (by ticking a box) that
they have read and understood the changes made to the course.

2. Please supply a copy of the review that you were asked to carry out
during the first half of the spring term of your compliance with consumer
protection law, as required in this letter from the Office for Students.

[2]https://www.officeforstudents.org.uk/med...

A review of the University’s compliance with consumer protection law was
conducted during the first half of the spring term, in accordance with the
OfS requirement. However, a timeframe for onward reporting of this review
to our governing body was not indicated in the OfS letter and due to the
timings of our committee meetings this has not yet taken place. The review
will be reported to our Board in due course, following which we will then
be in a position to release it.

This completes the University’s response to your information request. If
you are unhappy with the service you have received in relation to your
request and wish to make a complaint or request an internal review of our
decision please contact:

Director of DPO, email : [3][email address] or by post:
Kingston University, Hind Court, 106–114 London Road, Kingston upon
Thames, Surrey, KT2 6TN. Please note that we are unable to receive post to
this address, whilst staff are working away from campus as a result of the
Covid-19 situation.

In the event that you are not content with the outcome of your complaint
you may then apply directly to the Information Commissioner for a
decision. Generally, the Information Commissioner cannot make a decision
unless you have exhausted the complaints procedure provided by Kingston
University. The Information Commissioner can be contacted at:
