Dear De Montfort University,

I am making a request under the Freedom of Information Act 2000 (FOIA).

Please can you provide information pertaining to any data analytics software used by the university using personal data about your students and staff, since 2012.

1a). Whether you are using any data analytics software at all:
1b) if so, which ones?
1c) what date this data analytics processing began?
1d) indicate whether in the past and ended, or still in current use

2a). Any predictive analytics software such as used in but not only, Blackboard, Xray and JISC supported Civitas.
2b) if so, which ones?
2c) what date this analytics processing began for predictive purposes?

3. If the answer to Q1a or Q2a is yes, please provide a copy of any contract terms on using the data by the provider company including
a) the data items feedling analytics, any profiling, and/or used in prediction
b) what the prediction purposes / aims are
c) training the software (such as AI and machine learning) by the provider using the data provided via your organisation.

4. Whether the University is using its own student or staff population data for machine learning for purposes not included in 1-3 above? (ie but not only, within the university computing department for any project or with another third-party)

5. From which time periods were the student or staff data collected which are processed in any of the above (ie not only, retrospective student data from the last ten years / only current intake which began in autumn term 2018)?

6. How many people/user accounts have access to the whole population student data in any of the above in this calendar year?

Dear Jen,

I have been asked to get some clarification over the scope of the request. What do you mean by the term data analytics software? A point has been raised that in certain circumstances this will include Excel and similar software depending how they're used, which obviously has the potential to make this a very wide ranging request. If you could provide a more explicit description of what you're looking for this would be appreciated. Please note our 20 working day deadline will restart from receipt of clarification, though we will endeavour to provide an answer as soon as we're able.

Dear Freedom of Information,

By data analytics, we mean data analysis of behaviours, characterstics, attainment, profiling and assessment for the purposes of profiling or benchmarking individuals at scale, and often for the purposes of analysis of retention, or attainment. We exclude software such as excel, but rather packages intended for business intelligence, and which may be cloud based or shared at scale.

This may also include learning analytics and refers to the measurement, collection, analysis and reporting of data about the progress of learners and the contexts in which learning takes place.

I am hereby asking you to review the nil response, provide the requested information, and if necessary carry out Internal Review.

The questions pertained to "any data analytics software used by the university using personal data about your students and staff, since 2012."

You responded with no information found. However, the university was using data analytics software in 2015/16--unknown end date, called MyProgress, an analytical tool developed by HP DTP Solution Path. The tool captures student engagement by measuring access with the library, library resources, use of BlackBoard (assignment submissions, module information, learning resources), printing, copying, building entrances etc.

5. The MyProgress HP DTP Solution Path slides, in addition mention BlackBoard. Please provide the same information with regards to that provider, also a data analytics tool, and which should have been provided in response to the FOI of November 2018.

6. Please provide copy(ies) of any student privacy notice, relevant at the time of the processing of MyProgress, and for BlackBoard, as well as a contemporary copy (if updated since 2015).
