I am writing to request an internal review of Charity Commission for Northern Ireland's handling of my FOI request 'Status of; ENQ/14/365'.

In response to your allegation number (1) "value and purpose". The request is of immense value to a charity rendered broken. It's purpose is in the pathway to justice that may be afforded to the charity at the cessation of litigation that may be favourable to NMC Ltd, and other charities so affected. The information, is recorded information easily accessible by Commission staff.

In response to your allegation number (2) "context and history of previous communications and interactions with the Commission". I draw the inference that this remark may mean that as an advocacy service that has enjoyed considerable engagement with the Commission staff, our track record may have become uncomfortable to some officers. I apologise if this is the case.

 

In response to your allegation number (3)"The Commission consider that the request demonstrates an abuse of the right of access to information as part of a campaign to disrupt the work of the Charity Commission for Northern Ireland.". This allegation appears more sinister and I would ask that you amplify on this ground in the response contained within your review.

Finally, to wait the maximum amount of time before responding, and to then refuse a lawful request, may be seen as deliberate frustration of the spirit of the FOI Act. 

The request is not vexatious, it has real meaning and purpose, and is of public interest. Please conduct a review of the refusal to provide recorded information. I have copied this correspondence to the Permanent secretary given the departments responsibilities in these matters.
