Also, we don’t have a record of where taxi carriages and private hire
vehicles are licenced therefore we would not able to provide the number of
Hackney Carriages or Private Hire Vehicles involved in RTC’s whilst in the
area where they are licensed or in another area. 

Information regarding licenced Hackney Carriages and Private Hire Vehicles
may be held by the Local Authorities.

In relation to your email dated 14^th September 2018 concerning your FOI
request (FOI 448/2018), please accept our sincere apologies for the delay
in responding, there has been an error on our part.

 

As advised within our email to you, dated 15^th June 2018, requesting
clarification, if clarification is not received within 20 working days
then the request is closed, and in this case we believed that no
clarification was received within 20 working days, therefore your request
was then closed. However, following your email dated 14/09/18, a search of
our systems has been conducted and it now appears that you did respond
providing the sought clarification on 19^th June 2018 and unfortunately
that email was overlooked. Again, please accept our sincere apologies for
the inconvenience.

 

Furthermore, having reviewed your request again, it seems likely that your
request in its current format would exceed the appropriate time limit,
i.e. 18 hours, therefore we advise that you discuss this matter by
telephone with a member of staff within the FOI Unit in order for us to
provide advice and assistance in relation to refining/amending the request
with the aim of reducing the likelihood of it exceed the 18 hour time
limit. If you wish to discuss this matter, as suggested, please contact us

I write in connection with your request for information dated the 6^th
June 2018 and received in the FOI Unit on the same date regarding private
hire drivers.

 

This request is being handled under the Freedom of Information Act 2000.

 

Please accept our sincere apologies for the delay in responding.

 

Section 1 of the Freedom of Information Act 2000 places two duties on
public authorities. Unless exemptions apply, the first duty at Section
1(1)(a) is to confirm or deny whether the information specified in a
request is held. The second duty at Section 1(1)(b) is to disclose
information that has been confirmed as being held.

 

Dyfed-Powys Police are unable to confirm or not whether we hold
information relevant to your request, since we consider that the Section
12(2) exemption the Cost of Compliance exceeds the Appropriate Limit
applies to it.

 

Where exemptions are relied upon Section 17 of the Freedom of Information
Act 2000 requires Dyfed-Powys Police, when refusing to provide such
information (because the information is exempt) to provide you the
applicant with a notice which: (a) states that fact, (b) specifies the
exemption in question and (c) states (if that would not otherwise be
apparent) why the exemption applies.

 

Section 12(2) – The cost of compliance exceeds the Appropriate Limit

 

Section 12(2) states: “…Subsection (1) does not exempt the public
authority from its obligation to comply with paragraph (a) of section 1(1)
unless the estimated cost of complying with that paragraph alone would
exceed the appropriate limit.”

 

The cost of determining what information is held, if any, relevant to the
whole of the request is above the amount to which we are legally required
to respond i.e. the cost of locating and retrieving the information
exceeds the “appropriate level” as stated in the Freedom of Information
(Fees and Appropriate Limit) Regulations 2004. It is estimated that it
would exceed 18 hours (i.e. minimum of 1,651.33 hours) to comply with this
part of your request. The regulations can be located @

The Freedom of Information department has been advised that in order to
establish what information, if any, is held relevant to the whole of the
request would exceed the appropriate time/cost limit i.e. 18 hours. This
is due to the following reasons –

 

Questions 1 – 4

 

In order to establish the number of damage only RTC’s involving hackney
carriages/private hire vehicles would require the individual interrogation
of every incident recorded under damage only RTC category. Further to
this, every relevant damage only RTC recorded would require interrogation
in order to establish whether the RTC was fault or non-fault and whether
the RTC occurred in the drivers licensed area, if recorded. The relevant
time estimate is detailed below:

 

01/03/2017 – 31/08/2018: 9,731 RTC’s x a minimum of 10 minutes per record
= 1,621.83 hours

 

The number of injury RTC’s whereby a vehicle involved is recorded as
‘Taxi/Private hire car’ can be retrieved within the appropriate time
limit, however in order to establish whether the RTC was fault or
non-fault and whether the RTC occurred in the drivers licensed area, if
recorded, would require an individual interrogation of every injury RTC
recorded. The relevant time estimate is detailed below:

 

01/01/2017 – 25/09/2018: 37 RTC’s x a minimum of 10 minutes per record =
6.17 hours

 

Questions 5 – 10

 

In order to establish whether or not there are any criminal offences
recorded relevant to questions 5 and 6 of the request would require an
individual interrogation of all crimes recorded whereby the word ‘taxi’ is
mentioned within the crime.  An additional time estimate would apply to
questions 7 – 10, which cannot be determined without a response to
questions 5 and 6. The relevant time estimate in relation to question 5
and 6 is detailed below:

 

01/01/2017 – 31/08/2018: 140 records x a minimum of 10 minutes per record
= 23.33 hours

 

Therefore total time estimate to complete whole request = 1,651.33 hours

 

 

In accordance with the Freedom of Information Act 2000, this letter acts
as a Refusal Notice for the WHOLE of this request under Section 17(5) A
public authority which, in relation to any request for information, is
relying on a claim that section 12 or section 14 applies must, within the
time for complying with section 1(1), give the applicant a notice stating
that fact. You may wish to refine and resubmit your request so that it
reduces the time shown above to fall within the 18 hours. Should you
require any further advice in relation to this matter please don’t
hesitate to contact me.

 

Please also be advised that should the request be refined, it does not
remove the Force’s right to cite exemptions if relevant.

 

Although excess cost removed the force’s obligations under the Freedom of
Information Act, as a gesture of goodwill, I have supplied information,
relative to your request, retrieved or available before it was realised
that the fees limit would be exceeded - please see the attached response
document.

Nid yw'r e-bost hwn nag unrhyw ffeiliau a drosglwyddir gydag ef o
angenrheidrwydd yn adlewyrchu barn Heddlu Dyfed-Powys. Bwriedir yr e-bost

derbyn cyfrifoldeb am unrhyw ddifrod a achosir gan unrhyw firws a
drosglwyddir trwy gyfrwng yr e-bost hwn.
