Dear E-ACT,

I have recently been made aware of the SRE education policy of the Crest Academies in London, in particular, Clause 6, which states:

"The Governing Body will not permit the promotion of homosexuality."

As you may be already aware, this resembles the since-long repealed Section 28 of the Local Government Act 1988. I am unsure how such a policy comports with the public sector equality duty of an Academy, and am therefore requesting any documentation related to the formulation of this policy, and its impact on equalities, including, if available, the Equality Impact Assessment.

Dear FOI,

Apologies for the lateness in my response. I note that neither the policy has been taken down from its website (http://www.thecrestacademies.org.uk/docu...) nor has any information requested been provided, and it is approximately three weeks since your response. While I appreciate that it is out of term time, I would like to request an internal review for that reason.

I enclose copies of my response to the ICO’s complaint that you raised in
respect of the FOI request you made to E-ACT regarding Crest Academies’
SRE policy.

 

I also attach the information I sent to Ms Hyman of the ICO, this contains
email correspondence between E-ACT and our solicitors; this is for
information and clarity purposes only so that you can assess how we
reviewed the policy in light of your request.

 

E-ACT reacted to your FOI by tackling the immediate issue of remedying the
offending policy; and in doing this we failed to respond on the query of
whether there was an Equalities Impact Assessment in relation to the
offending policy. No EIA was found when we reviewed the origin of the
policy. I am confident that no EIA was undertaken because should it have
been, the reviewer should have realised that the policy was out of date
and discriminatory.

 

Please accept my apologies for this oversight and my thanks for raising
the matter with us.

 

Please do refer back to me or Ms Hyman at the ICO should you require any
further information or clarity on the matter.

 

I’m afraid that I have not been able to post a copy of this information to
you as we do not hold a postal address for you.
