With regards to your vascular services and its annual self-assessment (2019/2020) submission l request electronic copies of the following information.

1. The 2019/2020 annual self-assessment that was submitted via the Quality Surveillance Programme relating to the Specialised Vascular Services (Adult) Specification 170004/S.

2. If the Main Arterial centre declared a positive result (stated Yes)/compliance with indicator 170004S-001 - "There is an agreement outlining the network configuration", then l request copies of the evidence documents: operational policy (or part of) that supported this positive declaration.

3. If the Main Arterial centre declared a positive result (stated Yes)/compliance with indicator 170004S-017 - "There are patient pathways in place", then l request copies of the evidence documents: operational policy (or part of) including pathways that supported this positive declaration.

In order to reduce the scope of this part of the request, l include part of the indicator description that highlights my main interest:

Descriptor:
The AC should agree with the relevant service providers and relevant commissioners, network wide patient pathways for:

Peripheral Arterial Disease including:
- The management of acute limb ischaemia.

The pathway should include the following specifics;
- that emergency admissions should be reviewed by a consultant vascular surgeon within 12 hours

All the pathways should specify:
- the specific responsibilities of the involved providers, including the AC, the NAVCs and other providers;
- the indications for referral between providers (compatible with the levels of care model in the introduction to these indicators);
- the arrangements for transfer between providers for emergency surgery or interventions;
- any indications for case discussion at the weekly network MDT meeting;
- the relative responsibilities of the endovascular and open surgical specialists;
- referral pathways to other relevant specialties;
- the essential communications between professionals—what information should pass between which providers by which timelines;
- arrangements for patients who are turned down for vascular intervention and require palliative admission;
- locally relevant items including named providers and contact points.

Notes:
Pathways specify how the different Centres and groups of professionals should interact at defined stages of the patient journey, for diagnosis, assessment, management or follow up, as relevant.

4. If the Main Arterial centre declared a positive result (stated Yes)/compliance with indicator 170004S-021 - "There are clinical guidelines in place", then l request copies of the evidence documents: operational policy (or part of) including guidelines that supported this positive declaration.

Thank you for your response and l must commend you on what you have produced in relation to the specification/assessments as it surpasses what other Trusts have produced

It is however with regret that l ask you to perform an Internal Review as l do need responses to all my of questions in order for my research.

Please see below the questions asked, responses given and my comments to help you understand why l have asked for this internal review to be conducted.

1. The 2019/2020 annual self-assessment that was submitted via the Quality Surveillance Programme relating to the Specialised Vascular Services (Adult) Specification 170004/S.

Your response: Attachment "201920 Annual Self Assessment Document.pdf".

My comments: I would like to see the full document i.e. including the indicator descriptors/notes that you have omitted from the portal output.
Although l am almost 100% sure that all Trusts questioned received the same descriptors/notes l cannot be certain without the full document/text for each indicator.

2. If the Main Arterial centre declared a positive result (stated Yes)/compliance with indicator 170004S-001 - "There is an agreement outlining the network configuration", then l request copies of the evidence documents: operational policy (or part of) that supported this positive declaration.

My Comments: I noted the date of the last document review was 2012, nine years ago, however, it appears well written but more importantly relevant for its purpose. Questioned answered in full.

My comments: May l ask where are your network wide clinical guidelines or the list of those that your network members have all agreed to follow, even if it is just a simple document with a list of pointers to nationally recognised clinical guidelines?

With regards to my FOI request your ref: FOI/015775, entitled "Specialised Vascular Services Assessment".

On the 22nd July 2021 I requested an Internal Review given that the Trust had not provided all of the requested information to satisfy the request but as yet the Trust has not provided its response.

Regarding annual vascular assessments, l am sure you know that if your Trust did not implement all of the requirements set against each quality indicators then a negative response of "NO" to the appropriate indicator should have been indicated along with an appropriate comment.

From both discussions with and documentation obtained from the Specialised Commissioning Team I believe that the Quality Surveillance Team (QST) monitor assessments and as such can act on negative returns where and when appropriate, but obviously without accurate assessments the QST would be none the wiser. I also believe that in most cases a negative response is handled internally with an action plan put in place to rectify the non-compliance at some point in time.

The reason l mention the above is because it may be that the Trust has found an error with its official 2019/2020 submission given the complete omission of a response to question four of this FOI. Please note if errors have been detected with this submission then l would not expect the Trust to release documentation that may now be in progress etc.

Presently, NHS England, when l last contacted them were not aware of any errors with your 2019/2020 submission.

I hope to be in receipt of the Internal Review outcome before 40 working days have elapsed.

Thank you for your response although l am somewhat confused by it so l would be grateful for some clarification.

Please find my comments to the outstanding questions as of the Internal Review.

1. The 2019/2020 annual self-assessment that was submitted via the Quality Surveillance

As part of the Internal Review I mentioned that l would like to see the full self-assessment including the descriptors.

Is there a technical problem as other Trusts have managed to provide the self-assessment with the indicator descriptors intact.

Is this not just a simple matter of logging on to the Quality Surveillance Programme to obtain/print to pdf a copy of the assessment.

Please advise, I would be more than happy to submit another FOI with more explicit wording if its a wording issue.

Please see the assessment obtained directly from Worcestershire Royal Hospital that has all the sections intact.

I previously intimated that if your Trust had found errors with it 2019/2020 submission then l would not expect you to be able to provide documents that you do not have, but without knowing this l would expect the Trust to be able to provide the clinical guidelines as requested and as it declared via its submission.

Please could you re-read my questions taking note of what the indicator descriptor/the assessment requirements have stipulated. As the indicator descriptors are not visible on the assessment that your supplied then you can view the ones on the assessment provided by Worcestershire Royal Hospital as l believe all Trusts did receive the same assessment (but as mentioned l do need the assessment inclusive of the descriptors to be 100%).

I have not received your response regarding questions one and four of my FOI.

Question four is still unanswered as you have not provided the requested clinical guidelines.

Question one is debatable, Yes the data is held externally but the Trust as part of its contract with NHS England has to use the Quality Surveillance Portal to upload various statistics as part of its regular duties so without ICO input l would suggest it is acceptable to request this from you. Unless it is is not possible for you to download/print to pdf the submission with the indicator descriptors intact then of course l would have to contact NHS England.

Irrespective of question one, question four is still outstanding and the Trust has offered no explanation or advised of any exemption that it is applying to negate the release of the clinical guidelines/sop/network wide list of agreed guidelines etc that it uses and that was declared in its official declaration to NHS England.

Please let me know today what the Trusts intentions are, as otherwise as my last email indicated l will put in a complaint to the ICO over the weekend.

I am not sure what to make of your response, you have just sent the pathways again and not the requested documents as of question 4.

Your Trust either has the documents that it declared as having in its official submission or it does not?

If it does not then l assume the Trust may have made a mistake with its submission i.e. it should have declared NO instead of Yes to the descriptor/quality requirements. The alternative would be less palatable; maybe your CEO would care to comment given that they are ultimately responsible for these submissions?

Please either release the requested documents, state which exemptions you are applying or clarify if the Trust cannot release the documents due to mistakes being identified in their submission so we can conclude this FOI.

Dear Information Governance Department / The Dudley Group NHS Foundation Trust

Thank you for your response but at this stage if you do not have the requested evidence documents you may be better served contacting NHS England to advise them of your failings.

If the Trust does not have the required documentation termed evidence documents within the self-assessment then why did the Trust submit FALSE information to the commissioner of its vascular services, NHS England. I am surprised the CEO allowed it as they are ultimately responsible for the accuracy of the self-assessment.

By submitting FALSE information the Trust has also circumvented the monitoring of negative responses by the Quality Surveillance Team.
