Dear Mr Clifford,
Thank you for your recent request of 19/11/2020 where you requested
information about Southampton City Council Highways Services Partnership
contract with Balfour Beatty.
We do hold information within the terms of your request, however we need
more time to consider your request.
I wish to advise you that the following exemption applies to the
information that you have requested:
· Section 43 - Commercial Interests
This exemption is a qualified exemption, which means that the Council must
consider the public interest before making a decision as to whether this
information can be disclosed.
By virtue of section 10(3) of the FOIA, where public authorities have to
consider the balance of the public interest in relation to a request, they
do not have to comply with the request until such time as is reasonable in
the circumstances.
The Council has not yet reached a decision on the balance of the public
interest. Due to the need to consider, in all the circumstances of the
case, where the balance of the public interest lies in relation to the
information that you have requested, the Council will not be able to
respond to your request in full within 20 working days.
I hope to let you have a response as soon as possible, and no later than
19^th January 2020.
If you are dissatisfied with the handling of your request, you have the
right to ask for an internal review. Internal review requests should be
submitted within two months of the date of receipt of the response to your

I understand you were anticipating a response to your freedom of
information request no later than close of play, 17/12/2020.
Unfortunately, your request has taken longer than anticipated to process,
and as such the Council is not currently in a position to respond. This is
largely due to technical complication that have arisen with the Council’s
network this week, which have severely slowed my ability to compile all
the relevant documents required to respond.
However I hope to respond as soon as possible and will persist through
these issues to finalise and send out your response.
