Can you please provide the following information:

Number of advisors at Level 1,2 and 3 who got exemption from OISC as they are accredited by Solicitors Regulation Authority.

I write with reference to your email of 6/1/13 seeking information on OISC
advisers who are accredited by the SRA. I would be grateful if you clarify
your enquiry for me so that I can answer it appropriately.

 

Firstly, do you mean people who have taken and passed the SRA Immigration
and Asylum Accreditation Scheme assessments?

 

Secondly, do you mean advisers who are granted exemption by the
Commissioner and are thereby not required to pay a fee for registration
and are not entitled to charge a fee for their services or do you mean
those registered by the Commissioner.

 

I have taken your enquiry to mean that you wish to be provided with the
number of people who have taken and passed the SRA IAAAS and have
therefore not been required to go through the Commissioner’s assessment
scheme prior to registration but I would be grateful if you could confirm
that.

Dear Mr Vahi

 

I am the Commissioner’s Information Officer and it is my job to respond to
requests for information under either the Freedom of Information Act 2000
or the Data Protection 1998.

 

The response to your request is as follows:

 

The information you have requested is not recorded centrally by the
Commissioner. In order to provide you with the requested information I
would need to look at both the hard copy and electronic copies of the
records of registration/exemption of all parties currently authorised to
provide immigration advice and services.   

 

The FOI Act states that where a request exceeds a maximum cost (calculated
by reference to the hours taken to reply to a request) to the organisation
the request can be refused. That limit is set by the The Freedom of
Information and Data Protection (Appropriate Limit and Fees) Regulations
2004 (“the Fees Regulation”) and is set at £450 for  public bodies (other
than Central Government). The appropriate hourly rate (also set by the
Fees Regulation) is £25 hours per person. Thus if the more than 18 hours
of work is incurred in answering the request, the Commissioner is not
obliged to provide the information requested. Having considered your
request there is no doubt that answering your request, including locating
and considering the required documents, would take in excess of the 18
hour maximum. Accordingly, your request is refused under Section 12 of the
FOI Act. If you still wish to obtain the requested information the
Commissioner will be happy to provide it on payment of the costs of
providing it by you. If you wish to proceed on that basis please let me
know and I will provide you with a fee note for the appropriate amount
(calculated in accordance with the above figures and the FOI Act and the
Regulation Fees). 

 

If you are unhappy with my response to your request for information of
with the way that your request under the Freedom of Information Act has
been handled, then it is open to you to make a complaint to the OISC.
