Thank you for your information enquiry of the above reference number. Due to the nature of your request, it has been dealt with under the Freedom of Information (Scotland) Act 2002.

Please find attached structure charts which I trust will be of assistance. Please note some of the information requested is third party personal information and is exempt information under Section 38 (1) (b) Personal Information of the Freedom of Information (Scotland) Act 2002.

The Council considers that the disclosure of names/contact details of members of staff below senior management level would amount to unfair processing of personal data in contravention of Article 5(1) (a) of the General Data Protection Regulation (GDPR) which states personal data shall be processed lawfully, fairly and in a transparent manner in relation to the data subject. Therefore this information is exempt from disclosure under section 38 (1) (b) of the Freedom of Information (Scotland) Act 2002 (FOISA). The exemption is absolute, meaning it is not subject to the public interest test in section 2(1) of FOISA.

This letter acts as a refusal notice under section 16 of the Freedom of Information (Scotland) Act 2002 in relation to this information.

Data will be personal data if living individuals can be identified from it, or from it and other information in the possession of the Council or a member of the public. The Council considers that releasing names/contact details of members of staff below senior management level would enable you to identify individuals from the data.

The Council has a duty to keep personal information confidential unless the subject gives consent to its disclosure. This is not the type of information that members of the public would expect the Council to release into the public domain. The Council therefore considers that disclosure would amount to unfair processing and would contravene Article 5(1) of the GDPR 2016 and it has been removed from the attached documents.
