Further to your request of 11 March and our subsequent acknowledgement of
12 March, I can confirm that the Trust has dealt with this as a request
for information under the Environmental Information Regulations 2004.
Please see our responses to your questions below: -
 

 1. Reservoir name, consequence of failure and revised drawdown plan

While I can confirm that the Trust holds the information you have
requested here, we are withholding it from disclosure on the basis that it
would adversely affect national security and public safety in accordance
with Regulation 12(5)(a) of the Environmental Information Regulations
2004. The Trust has considered the public interest test in relation to the
application of this exception.
 
The factors in favour of withholding the information are that during the
current threat to national security which has been ‘substantial’ since
November 2019, there is a high level of public interest in not releasing
information that would result in a threat to public safety. If the Trust
were to release copies of this information it would be releasing key
details of the infrastructure and potential vulnerabilities of the
reservoirs concerned. This would prejudice the protection and safety of
the public through potential damage or disruption to the national
infrastructure by acts of sabotage.
 
The factors in favour of disclosure are that there is a general
presumption of openness and a need to promote accountability and
transparency in the Trust’s activities. However, the information you have
requested is not already in the public domain and while it’s release may
have a limited contribution to public debate concerning these reservoirs,
the Trust has determined that the factors in favour of withholding the
information outweigh the public interest factors in disclosing the
information.  
 

 2. Report from inspection ordered by EA and Status of any remedial work
recommended by report.

The information you have requested here is not held by the Trust; the
Environment Agency has ordered no such inspections.
