Sexual Harassment and Violence Statistics

Dear Queen's College, Oxford,

I write to request information regarding your Sexual Harassment and Violence policies and statistics over the past four years (2020, 2019, 2018, 2017). I would like to know:

1. The number of sexual harassment/sexual assault/rape complaints received by Queen's College, broken down by category and year

2. The number of sexual harassment/sexual assault/rape complaints received by the College concerning an event that took place during freshers' week

3. The number of sexual harassment/sexual assault/rape complaints received by the College that resulted in disciplinary action

4. The number of sexual harassment/sexual assault/rape complaints received by the College made by students against members of staff

5. The number of sexual harassment/sexual assault/rape complaints received by the College made by students in younger years against students in older years

6. The number of sexual harassment/sexual assault/rape complaints received by the College made by undergraduate students and the number made by post-graduate students

7. The college's policy on sexual harassment and violence

For the above requests, please provide information for the past 4 years (2020, 2019, 2018, 2017). For the year 2020, please provide as much information as currently exists.

Thank you for your email of 11 September 2020, which has been considered
under the Freedom of Information Act 2000 (‘the Act’). We apologise for
the delayed response to your request.

 

The College holds the information cited in your request.

 

The answers to your questions are as follows:

 

1.         The College is refusing to provide this information and relies
on the exemption for personal information at s40(2) of the Act. We
conclude that disclosure of this information would contravene principle
(a) of the principles relating to processing of personal data listed in
Article 5 of the General Data Protection Regulation (EU) 2016/679.
Specifically, the small numbers involved in the answers to your questions
present a very real risk that the individual(s) could be identified from
the information were it to be disclosed. We do not believe that any
legitimate interest in the disclosure of this information outweighs the
interests and rights of the individual(s) who might be so identified, and
the risk of serious harm or distress is in our view considerable. We are
mindful of the reasonable expectations of the individual(s) concerned,
particularly in relation to privacy, and we have also considered the
nature of the information, which arises from internal disciplinary
proceedings. Our conclusion is that disclosure of this information would
not therefore be lawful.
