Dear Bryan,

Thank you for your request for information. Scottish Water has determined
that this was a request for Environmental Information and therefore we are
required to deal with your request under the Environmental Information
(Scotland) Regulations 2004 (EIRs). We have applied the exemption
contained in section 39(2) of FOISA and will deal with your request for
environmental information under the EIRs alone.

The Environmental Information (Scotland) Regulations 2004 (EIRs) sit
alongside Scotland's FOI Act, and govern access to environmental
information held by Scottish public authorities.

Your request for information was for the following:

‘Could you please provide me with details of how many reports you have
received of internal and external sewer flooding by residents of Hazelwood
Road in Bridge of Weir over the past 10 years, and could you also provide
the dates of said reports.’
 
In response to your request, please find attached data we have extracted
regarding sewer related customer contacts in the PA11 3 area. The yellow
circle highlighted on the attached map reveals the area we have searched.
 
In total we have had 22 sewer related customer contacts in this area since
2003 (this is as far back as our customer contact systems go).
 
As per any customer contact extract to be used externally, any address
details and contact notes have been removed to comply with legal guidance
regarding the identification of flooding locations and guidance relating
to the General Data Protection Regulations (GDPR).  
 
With regard to the number of contacts it should be noted that as they
cover all “sewer related” contacts - not all will be related to flooding
and even when related to flooding the vast majority will be related to
chokes/blockages. Unfortunately the only way to begin to determine cause
is to analyse the content of the contact itself, which we have been unable
to do due to the volume of contacts.

It is also important that the party enquiring about flooding also checks
with the Local Authority Flooding Team to establish if there are any
general flooding issues in this area. The enquirer should also check with
SEPA regarding the risk of general flooding in this area. 
 
Should this enquiry be related to a development, we advise that prior to
any development taking place, and to allow us to conduct further
assessment of the development’s impact on the local network we encourage
the Developer to submit a Pre-Development Enquiry (PDE) forms (found at
[1]www.scottishwater.co.uk). We recommend all planned development relating
to more than a single house connection submits a PDE to Scottish Water as
early as possible. When the Developer submits the completed PDE form -
supplying as much information as they can about the development - this
detailed information will allow us to determine if further investigation
on the local network is required.
 
Some Information has been redacted from the attached documents because it
constitutes the personal data of third parties (some names, e-mail
addresses, phone numbers and other personal details) which may disclose
personal information, where such disclosure is not permitted. The
reference number held on Scottish Water’s system in this instance is
classed as personal data as it is unique to an individual and when
combined with other data held by us may allow that person to be
identified. Such information is personal data and has been withheld from
disclosure.
This exception is not subject to the ‘public interest test’, so we are not
required to consider if the public interest in disclosing the information
outweighs the public interest in applying the exception and therefore
exempt information under regulation 11(2) of the EIRS in conjunction with
regulation 11(3)(a)(i) on the basis that it would not be fair for the
redacted information to be disclosed. This covers Scottish Water
employees/contractors as there are no reasons to interfere with employees’
rights to expect privacy.
Disclosure of the personal data is not necessary to answer your request
and there are no reasons to interfere with employees’ rights to expect
privacy.
The exemption is absolute, so it is not subject to the public interest
test.
