Dear Wandsworth Safeguarding Adults Board,
York Court care home Battersea opened Sep 2013 closed itself December 2015 - was under service level investigation by the LA from June 2014 relating to matters of institutional and organisational abuse and negelcet - I have been informed by the police there was a report written by head of wandsworth safeguarding Clive Simmons (who has since retired)regarding that long standing investigation that found that home to have committed abuse neglect etc
The police suggested I request a copy of that report on York Court under FOI
As none of the relatives of the victims at that care home have seen the report - please can you supply

My request is long overdue so perhaps ammeding it will assist

I do understand that you have concerns about the decision in response to
your FOI (Freedom of Information) request and subsequently in response to
your request for an internal review of the initial FOI decision.

 

I have attached the FOI internal review outcome letter again for
information. This is the same letter that was emailed to you on 23^rd
February 2018, with a further email sent to you on 5^th March 2018 to
ensure that you had received all pages of the letter.

 

In making the initial decision in response to your FOI request, and then
undertaking the FOI internal review, the Council has followed the legal
requirements set down in the Freedom of Information Act. I’m afraid this
means there is no further action the Council can take regarding this
matter.

 

The legal regulator of the FOI Act is the ICO (Information Commissioner’s
Office) and its details are noted at the bottom of the attached letter
(and were similarly advised to you when the letter was  previously emailed
to you on 23^rd February and 5^th March 2018.

 

Therefore, if you continue to disagree with the response you have received
from the Council, you need to contact the ICO for further advice. As
noted, the ICO is the legal regulator of the FOI Act and can look at
complaints made by individuals. The ICO is entirely independent of the
Council.

 

Please be advised that the Council cannot engage in any further
correspondence regarding the decision made on your FOI request as that has
now been communicated to you a number of times. However, please let me
know if anything else in this email is unclear.
