SEND complaints policy and procedure Nov 2019

Dear Wirral Metropolitan Borough Council,

Please can you provide me with the SEND complaints procedure that you have created in November 2019 and distributed only to selected parent carers of SEND children, I have searched for the new policy on the local offer and it is not there.

Please also provide me with details of the consultation process you undertook in creating this document as I am a parent carer of a child with SEND who has an EHCP and not aware any consultation process on this new policy has taken place. Please provide me with the dates and how many parent carers took part in the consultation. Please also provide me with details of how you selected those parent carers to consult with.

Please also provide me with the details of who created the criteria and areas allowed to be complained about as these are very narrow and do not cover all areas of SEND as per the children and families act 2014.

Please also provide me with details of how the vexatious complaints procedure will be used in conjunction with this new policy and how you determine what is a genuine complaint against a vexatious complaint as the policy does not make it clear.

Dear Wirral Metropolitan Borough Council,

Please pass this on to the person who conducts Freedom of Information reviews.

I am writing to request an internal review of Wirral Metropolitan Borough Council's handling of my FOI request 'SEND complaints policy and procedure Nov 2019'.

My FOI has not been answered and Wirral Council have published a new policy without any consultation. The policy does not cover all aspects of SEND as is very limiting in its capacity. I would request that the legal department review this policy as a matter of urgency for its legality.

I also request this document is put to consultation as soon as possible in a view of coproduction and in line with the children’s and family act 2014
