SEND and ASC transport spend

Dear Southend on Sea Borough Council,

We are doing some research into the value of council / authority Special Education Needs & Disability and Adult Social Care transport contracts operated by private hire operators. To this end, could we please request your assistance in obtaining the information below, for your council / authority, under the Freedom of Information Act 2000:

Data request:

For the last 3 financial years (by year), and latest financial year (estimated):
1. Spend on Special Education Needs & Disability [SEND] transport i.e. taking children with SEND to and from school
2. Number of SEND passengers transported
3. Value of all council / authority SEND transport contracts awarded to taxi operators (PHV) (excluding coach hire)

4. Spend on Adult Social Care [ASC] transport i.e. taking elderly passengers to and from day centres
5. Number of ASC passengers transported
6. Value of all council / authority ASC transport contracts awarded to taxi operators (PHV) or taxi operators (excluding coach hire)

If actual figures aren’t available, is it possible to provide estimates instead? If yes, we would be grateful if you could indicate which figures are estimated.
By ‘contract awarded’ we mean in all contracts regardless of contracting approach e.g. open tender, framework, dps, or other.

Format: Please send through data in whichever format is easiest for you.

Clarification: If the request is unclear, please accept our apologies and let us know what clarification is needed. Similarly if it is not possible to provide the information requested due to it exceeding the cost of compliance limits, we would be grateful if you could advise as to how we might refine our request accordingly.

Re: Freedom of Information Request

 

I am writing regarding your request for information, which was received on
19.09.18.

 

In that request you asked us for information regarding SEND and ASC
transport.

 

However, under Section 43(2) of the Freedom of Information Act,
information is exempt from disclosure if complying with the request
“would, or would be likely to, prejudice the commercial interests of any
person (including the public authority holding it)”.

 

Information given under the Freedom of Information Act puts that knowledge
into the public domain and currently we are in the process of retendering
our transport service. The information that you have asked for is relevant
to any bid that may be made as a part of our tender process. This could
confer an unfair advantage on a tenderer that had this information over a
tenderer who did not. This would potentially result in the Council not
receiving the best value for money.

 

I conclude that providing you with this information would be potentially
harmful to the commercial interests of Southend Borough Council, and in
accordance with Section 43(2) of the Freedom of Information Act 2000 I am
therefore refusing your request to provide this information.

 

In applying this exemption, I have considered the public interest in
releasing this information and any potential harm that might result from
its release. In this case, disclosing this information would reduce our
ability to negotiate or compete in a commercial environment. Protecting
the commercial interests of the Council ensures that we are able to
receive best value for money. I therefore conclude that the public
interest does not outweigh the potential prejudice to the commercial
interests of Southend Borough Council.

 

We expect that this tender process will be complete by January 2019. If
you would like to make a new Freedom of Information Request at this time,
then please do so.

decision although generally the ICO cannot make a decision unless you have
