Dear Sam Ferguson,

 

I can confirm that we do hold information that falls within the scope of
your request. 

 

Section 12 of the Freedom of Information Act 2000 states that a public
authority is not obliged to comply with a request for information if the
authority estimates that the cost of complying with the request would
exceed the appropriate limit of either 18 hours and/or £450. 

 

We have identified a number of key officers that have e-mails and other
forms of communication in relation to SENCOM. To date 3,880 e-mails have
been identified for these officers only. These e-mails would need to be
reviewed for relevance to this request as they may relate to SENCOM
operational activities as well as the decision to withdraw from SENCOM.
Based on an estimated review time of 2 minutes per e-mail, this would
equate to over 129 hours to respond to your request in full. This greatly
exceeds the appropriate limit of 18 hours detailed above. However, section
16 of the Freedom of Information Act 2000 also sets out our duty as a
Public Authority to provide advice and assistance where we have applied
the section 12 exemption (as above).  As such, we would like to provide
you with information to explain the decision making process around SENCOM
during the time period you have requested.    

 

Please see below a timeline of events in relation to the decision making
process: -

 

•             April/May 2018 - each Head of Service was asked to consider
savings proposals for their individual service areas

•             September 2018 - A proposal to withdraw from the SENCOM
agreement was considered by the Senior Leadership Team (SLT). SLT formally
agreed to give notice to withdraw from SENCOM

•             September 2018 - agreed that this would be a Head of Service
decision (see attachment)

•             December 2018 - budget and Medium Term Financial Projections
report submitted to Cabinet - see
