The Council’s Response

The council has exempted this information under Section 43(2) of the
Freedom of Information Act.

Section 43 (2) states that:information is exempt if its disclosure would,
or would be likely to, prejudice the commercial interests of any person
(including the public authority holding it).

 

As we are currently in a competitive tender process, Children & Families
Service have exempted information under Section 43(2) of the Freedom of
Information Act.

 

 In order to apply Section 43, we must apply a Public Interest Test, that
is, consider whether the public interest would be better served by
withholding or disclosing the requested information.

 

In this case, therefore, we believe that we should apply Section 43 (2)
and exempt the requested information.

 

In Favour of Disclosure

* To encourage transparency in the Council’s decision-making processes

 

In Favour of Maintaining the Exemption

* The Council’s position in future procurement negotiations may be
jeopardised if this information is released during the tendering
process
* The Council’s position in negotiations with
prospective contractors will be jeopardised if information about
proposed charges is released to third party
* It would have a detrimental impact on the Council’s ability to
obtain value for money
* The position of the contractors in current or future negotiations may
be jeopardised if information on how they are able to offer their
services if  the information requested was released during tendering
process

 

Balance of Public Interest Test

The information you requested is exempt from disclosure, as the local
authority is currently undergoing tender for the above services and the
sharing of this information has potential to negatively impact on this
process if disclosed to a third party. 

 

Appeals & Complaints Procedure

If you are dissatisfied with this response and wish to appeal, please
reply to this email and this will be dealt with through our Internal
Review procedure.

 

Your request should be submitted to us within 40 working days of
receipt of this response. Any request received after this time will only
be considered at the discretion of the Council.
