Dear Stoke on Trent City Council,

Appendix 28 contained within the authorities Cabinet report dated 11th December 2018, covers a wide range of intended monitoring activities but which excludes any financial income and expenditure monitoring over the intended 5 year period.

Appendix 29 lists 6.5 members of staff costed for the scheme .

The two current selective licensing areas designations conclude on 4th August 2019 -could you provide an interim income and expenditure statement for the schemes duration until such time as the figures are firmed up including levels of staff employed.

Additionally as the 14 proposed new areas have yet, (and may never will ) receive the Secretory of States approval for designation the earliest the new schemes could commence is 8th October 2019 even if given approval today.
This means 6.5 members of staff are scheduled to be paid from 4th August 2019 until at least 8th October 2019 or an extra 2 months beyond the planned 5 years without any corresponding increase in income .

Please confirm the extra weekly costs and from which budget these additional wages will be paid.

We have now considered your request for information.

 

Whilst you have personally submitted 3 requests since October 2018, it has
come to our attention that your requests about selective licensing schemes
may form part of a larger project involving other individuals who have
also submitted many more requests all related to the selective licensing
schemes in Stoke-on-Trent.

 

Guidance issued by the Information Commissioner about “campaigns” states
that:-

 

91. If a public authority has reason to believe that several different
requesters are acting in concert as part of a campaign to disrupt the
organisation by virtue of the sheer weight of FOIA requests being
submitted, then it may take this into account when determining whether any
of those requests are vexatious.

 

The Information Commissioner’s Guidance asks that local authorities ensure
that the following criteria are met before it proceeds to refuse a request
on the grounds that it is vexatious under section 14 of the Act:-

 

1.    The requests [received from the requestor and other requestors] are
identical or similar.

 

2.    They have received email correspondence in which other requesters
have been copied in or mentioned.

 

3.    There is an unusual pattern of requests, for example a large number
have been submitted within a relatively short space of time.

 

4.    A group’s website makes an explicit reference to a campaign against
the authority.

 

23 requests have been received in the last 12 months (10 of these within
the last 6 months) in relation to selective licensing schemes in
Stoke-on-Trent, not only from you, but also from other requestors who are
engaged in challenging the schemes.

 

It should be noted that any request made to the Council is covered by
either the Freedom of Information Act 2000 or the Environmental
Information Regulations 2004 regardless of any reference to the
legislation in the request. The objective of the legislation is to make
available information held by a public authority and is not intended to be
used to inhibit the workings of a public authority. The volume of your
requests, together with those from other requestors, for similar
information, has led the Council to consider the impact of all the
requests on two very small teams within the local authority.

 

Some of your requests are covered by the Environmental Information
Regulations 2004 and are regarded as voluminous and a diversion of the
resources of the City Council and therefore it is manifestly unreasonable
to process the requests, in accordance with regulation 12(4)(b) of the
Environmental information Regulations 2004.

 

All of your requests, together with those of other requestors, are asking
for information surrounding the selective licensing scheme and housing.
These requests are considered burdensome and a heavy strain on valuable
public resources.

 

In accordance with the provisions of Section 14(1) of the Freedom of
Information Act 2000, which does not oblige a public authority to comply
with a request for information if the request is vexatious, the local
authority regretfully declines to comply with your most recent request.

Internal Review Investigation and Findings:

The City Council has now completed an Internal Review of your request for
information. Your request is being dealt with under the Environmental
Information Regulations 2004 as it concerns information that meets the
definitions found at Regulation 2(1)(c) and (f) of this legislation:

 

(c) measures (including administrative measures), such as policies,
legislation, plans, programmes, environmental agreements, and activities
affecting or likely to affect the elements and factors referred to in (a)
and (b) as well as measures or activities designed to protect those
elements;

(f) the state of human health and safety, including the contamination of
the food chain, where relevant, conditions of human life, cultural sites
and built structures inasmuch as they are or may be affected by the state
of the elements of the environment referred to in (a) or, through those
elements, by any of the matters referred to in (b) and (c);

 

As part of this Review we have liaised with the Strategic Manager for
Private Sector Housing. We have also considered in detail the Information
Commissioner’s Guidance in relation to Regulation 12(4)(b) of the
Environmental Information Regulations 2004, which concerns requests for
information that meet the criteria of “manifestly unreasonable”. As
further guidance we have considered Section 14 of the Freedom of
Information Act 2000, which concerns “vexatious” requests.

 

As part of this Review we have taken into account the volume and context
of your previous requests and those of other requests, of which we have
reason to believe you are connected with, in regards to the issue of
Selective Licensing in Stoke-on-Trent. Following careful consideration the
City Council has reached the decision that your Internal Review is upheld.
Please see provided below our response to your request for information.
Further details about our findings as part of this Internal Review
investigation are also detailed below:

 

Our Response to your request:

 

As this Internal Review has established that your request/s have not met
the criteria for refusal as “manifestly unreasonable” the City Council has
now taken steps to determine if we hold the information that you require.
We can advise that we do not hold the information that you are requesting.
Under Regulation 12(4)(a) of the Environmental Information Regulations we
can refuse a request for information if we do not hold it. Please see
further details below:

 

·         The two current selective licensing areas designations conclude
on 4th August 2019 -could you provide an interim income and expenditure
statement for the schemes duration until such time as the figures are
firmed up including levels of staff employed.

 

Response: We do not hold an interim income and expenditure statement and
are therefore unable to provide this to you. The Evaluation is currently
being undertaken for the two schemes, this includes the financial
accounts. This report will be published when all the information has been
collated later this year. Furthermore, the City Council has no business
requirement to produce an “interim” income and expenditure statement.

 

·         Additionally as the 14 proposed new areas have yet, and may not
ever receive the Secretory of States approval for designation. The
earliest the new schemes could commence is 8th October 2019 even if they
were given approval today. This means 6.5 members of staff are scheduled
to be paid from 4th August 2019 until at least 8th October 2019 or an
extra 2 months beyond the planned 5 years without any corresponding
increase in income.

Please confirm the extra weekly costs and from which budget these
additional wages will be paid.”

 

Response: We do not hold this information as we did not employ the 6.5
members of staff proposed for the 14 areas as we did not have confirmation
from the Secretary of State.

 

Our considerations at Internal Review in regards to the application of the
“Manifestly Unreasonable” Exception:

 

The City Council has received approximately 44 requests for information in
relation to Selective Licensing since January 2018, 14 of these were
received within a 6 month period. The City Council appreciates that the
Selective Licensing proposals are a controversial issue, and have raised
much public debate, so it is to be expected that there is an increase in
requests for information relating to this issue.

 

However, it is not only the quantity of the requests that have been
received that have caused a heavy burden upon the small Team who holds the
information, but also the large amount of information that is being
requested. This has impacted on the Teams ability to carry out their
duties effectively. The objective of the legislation that governs
information requests, is to make available information held by a public
authority, it is not intended to inhibit the day to day workings of a
public authority

 

As you may be aware, the City Council held a Public Consultation for
Selective Licensing between the period of 17 January 2018 and 30 April
2018. There was extensive activity to promote this consultation and
encourage the public to engage. Please see page 6 of the attached document
under the heading “Promotion of the Consultation”. The City Council then
responded to the submissions made through this consultation. These
responses can be viewed by following the link in the attached document.

 

The City Council has also placed a large amount of information online, at
the following link. This is in order for us to be transparent and open
with the public about the proposals and includes answers to many of the
questions that have been raised:

The City Council take its responsibilities under the Environmental
Information Regulations 2004 and the Freedom of Information Act 2000 very
seriously. We recognise the importance of the openness and transparency
promoted by these two access to information regimes. The City Council
believes that through our Selective Licensing Consultation; the
publication online of a large amount of information; our responses to a
significant number of requests for information and to questions at Full
Council, the proposal for Selective Licensing in Stoke-on-Trent has been
fully open to public scrutiny and we have responded comprehensively.

 

The City Council will of course consider any future requests from you in
line with our obligations under the Freedom of Information Act 2000 and
the Environmental Information Regulations 2004. However, requests on the
subject of Selective Licensing that are similar to that which you have
previously requested, or the City Council consider to meet the criteria of
“manifestly unreasonable” or “vexatious” in line with the legislation, may
be refused on this basis.
