Section 43 Terrorism Act Searches

Response to this request is long overdue. By law, under all circumstances, North Yorkshire Police should have responded by now (details). You can complain by requesting an internal review.

Please confirm the number of searches of persons reasonably suspected by police officers of being a terrorist (Section 43 Terrorism Act 2000) conducted in each of the last five years and,

Please confirm the percentage of searches that result in the searching-officer/s finding evidence that the detained person is a terrorist (within the statutory definition).

I am writing to request an internal review of North Yorkshire Police's handling of my FOI request 'Section 43 Terrorism Act Searches'.

Dear Civil Disclosure Officer,

You REFUSED my Request that NYP confirm the number of searches conducted under section 43 of The Terrorism Act 2000.

You have refused my Request because the number of searches under The Police and Criminal Evidence Act 1984 is readily available publicly.

I have considered the document you referred me to but the searches under PACE do not include searches under the Terrorism Act.

Your refusal is therefore not a legitimate refusal.
