Section 228 (7) Highways Act 1980 guidance

Mid Sussex District Council did not have the information requested.

Dear sir or madam,

Section 228 (7) Highways Act 1980 requires a "majority in rateable value of the owners of premises in the street" - https://www.legislation.gov.uk/ukpga/198...

Please provide any internal or external guidance you have in regards to how you would ascertain rateable value for this purpose for domestic and non-domestic properties.

If you do not have such guidance, why not? And how would you go about ascertaining rateable value if such an application was received under Section 228 (7) Highways Act 1980?

Dear Mr Cornish,

We believe your request should be directed to West Sussex County Council as they are the highways authority. The quoted piece of the Act talks about the majority in rateable value of homeowners of premises in the street applying to have a road adopted as a public highway.

For Council Tax and Non Domestic Rates, both these rateable values are set by the Valuation Office Agency.
