Matt Alsbury-Morris

Dear FOI,

Horsham DC is a relevant local authority for the purposes of the relevant acts. Please do not refer me on to Highways at West Sussex County Council. It is clear from your own website that you do make orders regarding temporary road closures (https://www.horsham.gov.uk/transportpage...) therefore please ensure that you carry out the relevant diligence regarding whether Horsham DC has issued any relevant orders.

Yours sincerely,

Matt Alsbury-Morris

FOI, Horsham District Council

FOI 2917 Further response

Dear Mr Alsbury-Morris

Your original request asked for the following information:

Dear Horsham District Council,

Please can you advise the numbers of TTROs applied for and the number
granted under Section 16a of the Road Traffic Regulation Act during 2018.

Where possible, please provide details of the roads affected by the
closures. Copies of application forms / maps submissions received would be
acceptable, there is no need to create a separate list where the
information is already in a readable format

Our initial response correctly referred you to West Sussex County Council
because TTROs under Section 16a of the Road Traffic Regulation Act are
used to deal with highway maintenance.

In accordance with the Council’s duty to provide advice and assistance to
requestors under Section 16 of the FOIA; I can advise you that HDC uses
Section 21 of the Town Police Clauses Act (TPCA) 1847 for temporary road
closures for the purposes of recreational use.

The Council aims to provide you with details of road closures in 2018
under the TPCA within the next three weeks.

Yours sincerely

FOI 2917 Review Response

Dear Mr Alsbury-Morris

Freedom of Information Act 2000 (FOIA) Review Response

Further to our acknowledgement we can now respond to your review request
about Temporary Traffic Regulation Orders.

I write to confirm that the Council has reviewed the handling of your
request for Information.

For ease of reference, I have set out a brief background to this matter:

• On 08/09/2018 the Council received your request for Information

• On 10/09/2018 the Council acknowledged your request

• On 10/09/2018 the Council responded to your request within 20 working
days referring you to West Sussex County Council (WSCC).

• On 14/09/2018 the Council received your request for a review.

• On 05/10/2018 the Council emailed you an interim response.

Your original request asked for the following information:

Dear Horsham District Council,

Please can you advise the numbers of TTROs applied for and the number
granted under Section 16a of the Road Traffic Regulation Act during 2018.

Where possible, please provide details of the roads affected by the
closures. Copies of application forms / maps submissions received would be
acceptable, there is no need to create a separate list where the
information is already in a readable format.

Your request for a review stated:

Horsham DC is a relevant local authority for the purposes of the relevant
acts. Please do not refer me on to Highways at West Sussex County Council.
It is clear from your own website that you do make orders regarding
temporary road closures
(https://www.horsham.gov.uk/transportpage...)
therefore please ensure that you carry out the relevant diligence
regarding whether Horsham DC has issued any relevant orders.

Having reviewed this matter, I can confirm that Horsham District Council
(HDC) did not make any TTRO's under Section 16A of the Road Traffic
Regulation Act (RTRA).

Section 16A RTRA states:

…(2) If the traffic authority for a road are satisfied that traffic on the
road should be restricted or prohibited for the purpose of—

(a) facilitating the holding of a relevant event,

(b) enabling members of the public to watch a relevant event, or

(c) reducing the disruption to traffic likely to be caused by a relevant
event,

the authority may by order restrict or prohibit temporarily the use of
that road, or any part of it, by vehicles or vehicles of any class or by
pedestrians, to such extent and subject to such conditions or exceptions
as they may consider necessary or expedient….

HDC is not the traffic authority for the above legislation, this is WSCC.
In accordance with the Council’s duty to provide advice and assistance to
requestors under Section 16 of the FOIA; I can advise you that HDC uses
Section 21 of the Town Police Clauses Act (TPCA) 1847 for temporary road
closures.

Under Section 21 of the TPCA 1847 the attached document show roads which
have been / will be closed during 2018.

The current list of applications for road closures can be found here:
[1]https://www.horsham.gov.uk/__data/assets...

The list of forthcoming temporary road closures can be found here:
[2]https://www.horsham.gov.uk/__data/assets...

This concludes the review process.

If you remain dissatisfied with this response, or wish to make a complaint
regarding the Council’s handling of your request, please refer your
complaint to the Information Commissioner at Wycliffe House, Water Lane,
Wilmslow, SK9 5AF.  Further details of this process are available on the
ICO website at [3]www.ICO.org.uk

There is no charge for making an appeal.

Yours sincerely
