Dear Tendring District Council,

I note with interest that Kiosk 5 is now fully trading again after a period of closure.

I am aware that an extensive schedule of dilapidations was presented to the previous leaseholder.

I note with interest and concern however that none of these manadatory repairs appear to have been carried out at the premises yet it is being allowed to operate as a food preparation and serving premises.

I request information on the following:

The date and evidence of the last asbestos survey carried out at the premises.
The date and evidence of the last legionella's report carried out at the premises.
The date and evidence of the last fire safety report carried out at the premises.

In addition any details of works carried out since January in compliance with the schedule of dilapidations served in October 2011.

The response to your email request was originally sent out to you on the 7
September 2012.  Unfortunately on replying a number of digits were missed
off from your address, causing the email to be undelivered.   I do
apologise for any inconvenience caused by this, and am now forwarding to
you the response to your request.

Thank you for your recent enquiry concerning the above.

 

In respect of the points raised by you and the information requested I
will endeavour for the purpose of clarity to provide the responses in
order.

 

Kiosk 5 is not fully trading again but is operating under a temporary
arrangement for one season only pending a decision to be made by the
Council in respect of longer term business proposals received.

 

The legionella report and the fire safety report will be resolved and
incorporated into proposals relating to the longer term future of this
business.

 

However, with regard to safety and fire safety in particular, the
electricity in the kiosk was bought up to standard and the relevant NICEIC
safety certificate is available at the Council should you wish to view it.
This has not been attached due to it being over 4 pages which require
scanning and attaching.

 

Attached as requested is a copy of the asbestos report received. The
management plan for this will also be incorporated into all proposals
relating to the longer term future of the business.

 

With regard to the general list of dilapidations it is also clear that
many of the original requirements will be not only addressed but are
likely to be considerably improved and enhanced as a result of proposals
for the longer term use of this building.

 

However, for the short term and the duration of this summers trading
period the Council is satisfied with a number of improvements that that
have been carried out to the kiosk.

 

These include

 

 1. New electrical installations
 2. Repairs to the roof
 3. redecoration
 4. replacement of broken tiles inside
 5. repairs to the toilets
 6. new kitchen equipment including a deep clean of the premises.

 

In closing, I hope the information supplied is helpful although if I can
