Your information request to Blackpool Borough Council

Thank you for your correspondence dated 4 February 2009 in which you complain about Blackpool?s failure to respond to your information request.

In cases such as this the Commissioner does not consider that serving a formal decision notice would serve any strong public interest. However, I have written to the public authority to provide them with a copy of your original request reminding it of its responsibilities and asking it to respond to you within 10 working days of receiving our letter. I enclose a copy for your information.??

As you will see, even though the Commissioner does not intend to issue a formal notice in this case, your concerns have been taken seriously. Thank you for bringing this matter to the attention of the Information Commissioner.

If Blackpool responds and refuses to release the information you have asked for and you are dissatisfied, you may, after exhausting their internal complaints procedure, complain to us again.

This case has now been closed with the delayed response element showing as ?withdrawn? on our records. The Information Commissioner has received a complaint from Mr Thackeray stating that no response has been sent to an information request submitted to your organisation on 4 February 2009, which you have said was received. Any public authority in receipt of such a request is under a duty to respond within 20 working days of receipt. As it is the case that you have not responded but acknowledged receipt of the request, we would ask that you now respond within 10 working days of receipt of this letter. FREEDOM OF INFORMATION ACT 2000 - INFORMATION REQUEST

Further to your correspondence and that received from the
Information Commissioner regarding your request for information, I
would like to apologies on behalf of the Council for the lack of
progress in dealing with your request.

I have initiated a search of our records for the information
requested, and any information found in relation to your request
will be forward to me for compilation and disclosure. The Council
does not maintain a central electronic database of `gifts' and I
have therefore requested a search of the manual records held by
the individual departments.

The Council is currently reviewing its processes and refreshing
training with staff to address issues raised, and I have notified
the Information Commissioner's office of our planned actions.

I will contact you shortly with the outcome of the searches and
any information found.
