Dear East Dunbartonshire Council,

BACKGROUND:
I recently requested documentation of the steps taken by Bearsden Academy to ensure that their school uniform policy (1) met with Equalities legislation and (2) took into account the needs of pupils with strongly held beliefs (eg: feminists, religious minorities).

You have informed me that such steps were taken but that you do not hold records of what those steps were. Depending on whether information was destroyed, and when that desctuction took place, this may constitue a failure to retain records under the Public Records Scotland Act 2011 and the EDC Records Management Plan as agreed with the Keeper of Records of Scotland.

INFORMATION REQUESTED:

1. Please provide a copy of the current EDC Records Management Plan.

2. Is documentation of school uniform policy - breaches of which can lead to the exclusion of children from education - considered by EDC as falling under section 10.001.001 (Strategies and policies documenting the conditions of access to education services) of SCARRS as part of EDC’s Records Management Plan?

3. If not, which section of SCARRS does EDC consider school uniform policy comes under?

provide the following response on behalf of East Dunbartonshire Council:

Your request for information:

1. Please provide a copy of the current EDC Records Management Plan

This is the current Records Management Plan which will be updated for the
Keeper of the records of Scotland in 2019.

2. Is documentation of school uniform policy - breaches of which can lead
to the exclusion of children from education - considered by EDC as falling
under section 10.001.001 (Strategies and policies documenting the
conditions of access to education services) of SCARRS as part of EDC?s
Records Management Plan?

Retention schedules detailing school uniform guidance do not fall under the
Business Classification you cite: 10.001 (Access and Inclusion) Retention
schedule 10.001.001 (Strategies and policies documenting the conditions of
access to education services)

3. If not, which section of SCARRS does EDC consider school uniform policy
comes under?

Business Classification 10.009 (Management of Schools), Retention Schedule
10.009.011 (Handbook) is the area of business which covers school uniform
guidelines. This guidance is provided in the school handbook which is
published on the individual establishment website.

Should you have any questions on the content of the response and would like
the Local Authority to clarify or explain, please do feel free to get in

If you are dissatisfied with the way in which East Dunbartonshire Council
responded to your request, you are entitled to require the Council to
review its decision. The review will be handled by staff who were not
