School funding in Powys

Dear Powys County Council,

I'd like to make a request under the Freedom of Information Act for the following information:

1. The funding allocated to each Primary, Secondary, Through and Special School for the financial year 2019-20, broken down by each individual formula element.

2. The pupil numbers and all other factors used to fund each school.

3. The details, at a budget holder level of all centrally retained budgets that form part of the non delegated schools service and other related services budget areas.

For avoidance of doubt, I am making this request under the Freedom of Information Act. I await your response within 20 working days.

School Funding     

 

The above is a summary of your request. The full details of the

to the information not being exempt or containing a reference to a third
party. In some circumstances Powys County Council may be unable to achieve

the information you request. If this is the case you will be informed and

This is to inform you that your request has been considered and I can

The Request:

 

1.     The funding allocated to each Primary, Secondary, Through and
Special School for the financial year 2019-20, broken down by each
individual formula element.

      Please find all three excel spreadsheets attached.

 

2.     The pupil numbers and all other factors used to fund each school

The pupil numbers are shown on the attached sheets and the description of
the formula shows the details funding calculations.

 

    3. The details, at a budget holder level of all centrally retained
budgets that form part of the non-delegated schools service and other
related services budget areas.

As stated in Section 21 of the act, this information is accessible by
other means. Powys County Council’s budget book has been released on the

Section 17 of the Freedom of Information Act 2000 requires Powys County
Council, when refusing to provide such information (because the
information is exempt) to provide you the applicant with a notice which:

(a)  states that fact;

(b)  specifies the exemption in question and

(c)   states (if that would not otherwise be apparent) why the exemption
applies.

In this instance the relevant exemption is Section 21 of the Freedom of
Information Act.

Section 21: Information accessible to applicant by other means -

(1) Information which is reasonably accessible to the applicant otherwise
than under section 1 is exempt information.

(2) For the purposes of subsection (1) -

(a) Information may be reasonably accessible to the applicant even though
it is accessible only on payment, and,

(b) Information is to be taken to be reasonably accessible to the
applicant if it is information which the public authority or any other
person is obliged by or under any enactment to communicate (otherwise than
by making the information available for inspection) to members of the
public on request, whether free of charge or on payment.

Dear Information Compliance,

Thank you for the provided information. However, having accessed the Budget Book information on the Powys website, it does not provide the information requested under point 3 of my request.

This is due to :-
1. The web site does not include the budget book for the current 2019-20 financial year and
2. The information provided in the budget book is not at the Budget Holder level as requested.

Therefore could you please provide the information as originally requested—namely the details, at a budget holder level of all centrally retained budgets that form part of the non-delegated schools service and other related services budget areas.

Dear Powys County Council,

Please pass this on to the person who conducts Freedom of Information reviews.

I am writing to request an internal review of Powys County Council's handling of my FOI request 'School funding in Powys'.

I requested the following information on 22nd March 2019: the details, at a budget holder level of all centrally retained budgets that form part of the non-delegated schools service and other related services budget areas.

On 10 May, well after the deadline for the information, I was sent the following reply:

"As stated in Section 21 of the act, this information is accessible by other means. Powys County Council’s budget book has been released on the website. Here is the URL link to follow:

On 13 May I pointed out that this did not contain the information I requested. First the web link did not include the budget book for the current 2019-20 financial year and secondly the information provided in the budget book is not at the Budget Holder level as requested.

I have had no answer to my email of 13 May. I am still waiting for the information I requested nearly two months after the initial request.

We acknowledge receipt of your expression of dissatisfaction email regarding the information given in our response for Freedom of Information Requests referenced F2019-0362. We regret that you have expressed dissatisfaction in the service provided by Powys County Council in respect of your request for information and will conduct an internal review investigation. Your complaint will be referred to the most appropriate individual to take this forward.

We apologise for not acknowledging your email sent on the 13/05/2019. The Information Compliance Team felt that we needed to hold discussions with the service area who provided answers in order to determine how it was best to take your email forward.

Powys County Council attempts to respond to requests for a review within 20 working days, however, this is not always possible, but we will try to issue a response by 14/06/2019.
