Essex Police is currently dealing with an unprecedented increase in requests for information under the Data Protection Act (Subject Access), the Freedom of Information Act, and from Family Courts. The force is working hard to develop longer-term solutions to keep pace with that demand, but while we await those solutions to come in to effect it is likely that some of our responses to information requests will not be as swift as we and our requestors would like. Our focus will always be protecting our public and the most vulnerable within our community, and therefore, requests that fall into this category will be prioritised.

We must firstly apologise for the lack of updates from this department.
Your original request had been misplaced in our inbox and therefore, we
were unable to log and send you an acknowledgement as we would normally
do. 

 

Section 1 of the Freedom of Information Act 2000 (FOIA) places two duties
on public authorities. Unless exemptions apply, the first duty at Section
1(1)(a) is to confirm or deny whether the information specified in a
request is held. The second duty at Section 1(1)(b) is to disclose
information that has been confirmed as being held.  Where exemptions are
relied upon Section 17 of the FOIA requires that we provide the applicant
with a notice which: a) states that fact b) specifies the exemption(s) in
question and c) states (if that would not otherwise be apparent) why the
exemption applies.

 

In respect of your enquiry:

Having completed enquiries within Essex Police, we are able to respond as
follows:

 

In respect of Sec1(1)(a) Essex Police does hold information relating to
your request however this information is already published by the OPFCC ,
therefore for the purpose of section 17 of the Freedom of Information Act
2000 (FOIA), this part of our response serves as a formal notification of
refusal of your request on the basis that the exemption given at Section
21 of the FOIA applies (Information accessible by other means).

 

Section 21 of the Act (Information Reasonably Accessible by Other Means)
states that information is exempt information if it is reasonably
accessible to the applicant otherwise than under Section 1 of the Freedom
of Information Act 2000.

 

Section 21 is an absolute exemption and where information falls within the
scope of an absolute exemption, a public authority is not obliged to
communicate it to an applicant and is also not obliged to comply with the
duty to confirm or deny the existence of the information requested.

 

However, having said the above and in an effort to assist Essex Police can
provide the attached document containing the Scheme of Delegation dated
November 2012 and the following link to the Police, Fire and Crime
Commissioner's website which contains the current Scheme of Delegation.

I never requested for the PCC Scheme pursuant to the Police Reform Responsibility Act 2011 I requested the Chief Constable's Scheme pursuant to eh Police Reform Act 2002.

Essex Police is in receipt of your complaint to FOI request 12922
regarding Scheme of Delegation document.

 

Essex Police will conduct a review as requested.

 

As you will be aware, the Information Commissioner's guidance for reviews
held under Section 50 of the Act is that they should be completed
within twenty working days of receipt of the complaint (unless exceptional
circumstances arise in which case the authority may extend the deadline by
a further twenty days) this will give a deadline of the 17 May 2019 (Janet
Bloomfield sent us the request on 16 April 2019).

 

As advised in our reply, if you are not content with the outcome of the
review, you have the right to apply directly to the Information
