SBCV site visits

Dear Calderdale Metropolitan Borough Council,

I recently recieved a letter (BC/IJG/SEG) in reply to my questions about the SBCV development site (planning application 11/00200/FUL)which stated that - "The site is inspected every 48 hours as a minimum by I & H BROWN to ensure that the fencing is not damaged to allow unauthorised access. Calderdale council officers also conduct regular site visits and inspections".

Please can you supply the following information.

1. Dates and times that I & H Brown have conducted inspections since the 31st of May 2012.
2. Dates, times and names of planning officers who have visted and inspected the site and their reports since planning permission was granted.

I am writing to request an internal review of Calderdale Metropolitan Borough Council's handling of my FOI request 'SBCV site visits'.

In my FOI request I specifically asked for dates and times of each site visit by planning officers. Only one date of 09/03/12 was given. The reason given was that Mr Child did not claim expenses so no record were available. Surely Mr Child has to provide details of each time he is away from the office and record details of any site visits in a log book.

I also asked for the reports from such site visits which appears to have been ignored. I would think that any officer conducting a site visit especially in relation to planning enforcement would have to record detailed on site reports.

Request for an internal review

 

Thank you for your request for an internal review of response 10526 under
the Freedom of Information Act 2000.

 

Request

 

1. Date and times that I and H Brown have conducted inspections since the
31^st of May 2012.

2. Dates, times and names of planning officers who have visited and
inspected the site and their reports since planning permission was
granted.

 

Response

 

In carrying out the review I can confirm that the request was received by
my team on 17^th August 2012 and was acknowledged the same day. Our
response was issued on 10^th September within the statutory timescales.
Therefore procedurally the request was handled in accordance with the law.

 

Having looked at the detail within your request and having spoken directly
to the Economy and Environment Service who deal with such visits I can
confirm that the response issued by John Giddings was in fact correct. The
Freedom of Information Act only requires us to disclose information that
we hold. Any information regarding conducted inspections by I and H Brown
since the 31^st of May 2012 are not held here. The data may be available
directly form them however. We are not required to generate additional
work tasks in order to comply. It is quite often the case that data
regarding visits and personnel by external partners are not recorded by
us.

 

In regards to visits made by our officers, again I can confirm that
various visits were made, as detailed in our original response but precise
details are not held as they are not required to be. Planners often attend
a number of sites when they leave our premises and we do not hold a log
book of the dates, times and locations of their visits therefore we cannot
provide any additional information over and above that already provided
previously.

 

 

For the reasons stated above I therefore uphold our original position.
