FREEDOM OF INFORMATION REQUEST

In 2014 Salhouse Parish Council corresponded with Post Office Ltd to secure continuous post office services in Salhouse. In January 2017 Salhouse Parish Council minute that they are aware of the closure of the Post Office in Salhouse. In April 2017 the Post Office in Salhouse closed.

FOI 1
Between January 2017 and October 2017, did Salhouse Parish Council contact Post Office Ltd to discuss options (e.g. relocation of counter service and/or taking up a franchise through a new postmaster) so as to ensure a post office services were not lost for parishioners in Salhouse?

Salhouse Parish Council discussed a community bid for the Bell Public House and for the Post Office at its March & April 2017 meetings. At the 6.3.17 meeting the clerk was asked to contact Upton Parish Council.

Please provide a copy of all correspondence between SPC and Upton Parish Council.

At the 3.4.17 meeting Salhouse Parish Council withdrew from interest in the Bell Public House but resolved to ‘stay in touch with Plunkett Foundation’.

FOI 3.
Please provide a copy of all correspondence between SPC and Plunkett Foundation between Jan 2017 and October 2017. This includes the letter to the Plunkett Foundation from Cllr McCormick which the council resolved he send at the 26.6.17 parish council meeting.

Please provide a copy of all correspondence between January 2017 and October 2017 between SPC explores and the Public Works Board in respect to securing a loan.

FOI 5
Please provide a copy of SPC’s Business Plan that it resolved to draw up at the 26.6.17 parish council meeting.

FOI 6
Please provide a copy of any surveyor/estate agent valuations that SPC obtained to support its Business Plan.

It is understood that all financial details will be blacked out from view. However, the purpose of FOI 5 & 6 is to understand the formal plans/processes that SPC resolved to undertake in order to purchase 82b Lower Street, Salhouse.

Dear Salhouse Parish Council,

Thank you for the response of 19.1.20. I request a review of my FOI for the following reasons.

In my FOI Request 2 - the response from SPC is that the council 'does not hold this information'. Please can it be confirmed whether the council does not hold the information because the correspondence between Upton & Salhouse was deleted or whether that it was never sent in the first place?

I am writing to request an internal review of Salhouse Parish Council's handling of my FOI request 'Salhouse P/O meetings, minutes and correspondence between 2014 through 2017 as listed.'.

In my FOI Request 2 - the response from SPC is that the council 'does not hold this information'. Please can it be confirmed whether the council does not hold the information because the correspondence between Upton & Salhouse was deleted or whether that it was never sent in the first place?

Please pass this on to the person who conducts Freedom of Information reviews.

Dear Mr Stowers,

 

In response to your request for Salhouse PC to conduct an Internal Review
we will revisit all of the correspondence that you have sent us, directly
and indirectly, and review it to determine:

o That any and all FOIA requests identified are valid
o Whether any clarifications are needed to determine the request to
enable us to fulfil our obligations
o Whether the information being requested is actually held by us
o Estimate whether the cost of retrieving and disclosing any information
exceeds the threshold above which we are not required to proceed,
in which case we will inform you to give you options

Assuming we believe there is information to disclose we will:

o Undertake the search which will also include requests to councillors
to search their personal electronic devices and for copies of
any correspondence that they may have in relation to the request 
o Review it and decide whether to disclose it or to seek an exemption in
line with the FOIA 2000

If we find that we have not disclosed information that we should have
released, or have wrongly applied an exemption and should have released
that information, then we will disclose the information as soon as
possible but no later than 28th February. Whilst we appreciate this date
may be beyond 20 working days from the time of your request for an
internal review, we ask for your understanding in these difficult times.
If we feel we cannot meet this target date then we will let you know.

 

Please note that, under the FOIA, an authority is only required to provide
actual documentation it holds, it is not required to provide explanations
as to why it may or may not have the information being requested, unless
there is a transcript of the explanation or equivalent physical evidence.
If we declare that we do not hold the information you are requesting it is
because we do not hold it. Our response is devoid of any external
influences and we will be acting in accordance with the law.

 

If, after receiving the outcome of our internal review, you are still not
satisfied then I am obliged to remind you that you have the right to
address your concerns or make a complaint to the Information
Commissioner’s Office (ICO) who will assign a case officer. That event, we
will be more than happy to cooperate fully with the case officer and take
whatever steps are needed to resolve any outstanding issues as required.
