As such, the salary details of the incoming President will be published in due course and are therefore exempt from disclosure under Section 22 of the Freedom of Information Act – information intended for future publication.

Section 22 paragraph (c) says "it is reasonable in all the circumstances that the information should be withheld from disclosure until the date referred to in paragraph (a)."

I am writing in response to your request for an explanation of how paragraph 22(c) of the FOIA has been satisfied in relation to your request for the ‘salary details of the incoming President and Rector of the college, Alice Gast’

The College acknowledges that there is a public interest in the remuneration of University Vice-Chancellors. However, there is a very well established process for satisfying this public interest. All universities include details of the Vice-Chancellor’s (or their equivalent’s) remuneration in the annual accounts published each year. These can then be scrutinised together so that there is transparency, both within individual institutions and across the sector. As you will be aware, the Times Higher has for several years published an annual survey of all V-Cs’ remuneration based on the information provided in university annual accounts. This survey not only reveals the individual remuneration packages, but makes comparisons between them.

We see no benefit in disrupting this well-established process by publishing the incoming President’s salary outside of the normal timescales for publication. Not only would this disrupt the normal process for publishing V-Cs’ salaries, it could also be misleading, in that it would encourage comparisons to be made between Professor Gast’s proposed salary for next year and the salaries paid to other vice-chancellors in previous years. Any such comparisons would be misleading because they would not be comparing like-for-like.

The College also believes that it is not in the public interest to release the details of someone’s proposed salary before that person has commenced their employment with the College. We believe that doing so could prejudice the recruitment processes for members of the senior staff, and in some cases, could result in good candidates either not applying for senior posts, or withdrawing the candidacy during the recruitment process. This would not be in the public interest.

Furthermore, as Professor Gast has not yet commenced her appointment as the President of Imperial College, she is still a private individual rather than an employee of Imperial College. As such she is entitled to a greater degree of privacy than would normally be afforded to senior staff at a university.

For all these reasons, the College believes that it is reasonable in all the circumstances that the information should be withheld from disclosure until it is published in the College’s annual accounts.
