Dear South Holland District Council,

In accordance with the Freedom of Information Act 2000, I would like to formally make a request regarding s.106 agreements that were signed between January 2000 and December 2015.

Therefore, please can you provide the following information:

• The date the agreement was signed along with the corresponding planning reference;
• list all contributions and their intended purpose;
• the dates of when all and any contributions were received by the council;
• the project name and details to which any contributions were allocated, expended or committed;
• the total amount allocated, expended or committed per contribution and the date this was done;
• the total amount that remains unspent and/or unallocated per contribution;
• please confirm whether the contribution monies, either in whole or part, were held in an interest bearing account;
• name of the party/parties that paid the contribution;
• name of the party/parties that have been repaid and when;
• all council spreadsheets that contain the requested information; and
• Finally, please include either copies of the s.106 agreements or live links to where the agreements can be found.

Good morning

Thank you for your information access request received on the 10/02/2023
where you asked for information regarding S.106 Agreements.

Under Section 1(1)(a) of the Freedom of Information Act 2000 we can
confirm that South Holland District Council does hold the information
specified in your request.

In accordance with the Freedom of Information Act 2000, I would like to
formally make a request regarding s.106 agreements that were signed
between January 2000 and December 2015. 

 

Therefore, please can you provide the following information:

In response to your FOI request please see the attached spreadsheet for
details of the Section 106 agreements.  The S106 agreements are publicly
available on our website.

With respect to NHS and education contributions these are paid to SHDC,
then forwarded on to LCC and NHS.  With regard to timescales it is for
those bodies to determine, however S106 agreements include a clause that
the money be returned to the developer if it is not spent within a
specified time period.

The South East Lincolnshire Local Plan was supported by an Infrastructure
Delivery Plan which is available to view here: Other Reports Template

With regard to reductions in contributions ,most notably in respect of
affordable housing this is relevant to the following cases:

H09-0521-14 Manor Farm (Holbeach Meadows) Deed of Variation H09-0416-19 –
no affordable housing on first phase of 330 dwellings (Reserved Matters
approval H09-0331-17), affordable housing contribution reduced from 33.3%
to 25% of the remaining 570 dwellings.

You will note there is a current undetermined application H09-1093-22
which seeks to reduce the S106 contributions ie removal of requirement to
pay £1 million towards the provision of Peppermint Junction and removal of
the requirement to provide affordable housing, (100 affordable housing
units are proposed under current undetermined application H09-0845-22.

H09-0288-15 Balmoral Way, Deed of Variation H09-0707-19 reduced affordable
housing contribution from 33.3% to 27% (12 to 9 units).

H09-0613-21 Land to east of Chaffinch Way – S106 included full education
and NHS contributions with 9 affordable units (11.11%).

H09-0276-19 Fen Road – S106 included 7 units of affordable housing (8.4%),
full education and NHS contributions.
