S106 agreement for former nature's world site

Dear Middlesbrough Council,

I seek information regarding the S106 agreement for the former nature's world site. The security of the site is unacceptable and businesses that operate from there are suffering as a consequence.

Please can you tell me the intended purposes of the funding, the amount of funding allocated and if replacement security fencing has been considered as part of the scheme.

I also wish to know the limitation with regards to time.

I am writing to confirm that Middlesbrough Council has now completed its
search for the information you requested on 16^th May 2021. 

 

In your request you asked for the following information:

Response:   

 

The S106 Agreement has yet to be signed.  As the site was in the ownership
of the Council at the time that the planning application was signed the
Council cannot enter into a S106 Agreement with itself.  Instead a S111
Agreement has been signed, this has the same affect as the S106 Agreement
and is legally binding.  Now that the land has been transferred from
Council ownership the S106 Agreement can be formally completed.

 

A copy of the S111 Agreement, containing the S106 Agreement, is attached
for your information.
