Dear Requestor,

 

I have been asked by the team dealing with your request to seek
clarification from you.

 

As it stands the team consider the request too broad and are concerned
that because you are asking for 25 years’ worth of information that it
might be refused for being unreasonable.  They also advise that much of
the detail for this period will no longer be available, particularly for
1990 – 1993, when we were insured with MMI, who went into administration /
solvent (now insolvent) run off in 1993.  They have advised that you may
wish to reduce your time period to 10 years maximum.

 

Please let us know by Wednesday, 30 May 2018.  If we do not hear from you
by this time we will consider that you no longer require this information
and your request will be closed.

Thanks for your reply. Please therefore dispand with all numbered instructions in favour of the following:

Please kindly provide just the total compensation for damage caused due to poor condition of roads (potholes, etc) paid by year, starting with 2015 and work backwards until the information is no longer stored in an easily accessible format.

We would like payments to be based on when the damage occurred. For example if the damage occurred in 2014 we would prefer the amount paid to appear in the 2014 column and so on. If you cannot arrange the data in this way then please kindly base it on the year the claim was made. For instance if the claim was made in the year 2015 then kindly arrange for the amount paid to appear in 2015. If however you are again unable to arrange the data in this way then kindly provide it in any available way stating how it is arranged.

It is our preference for these figures to include any additional costs (such as legal fees). If this is not possible then please kindly provide the data anyway and state what is included.

The responses to the FOI questions raised are qualified since the Council
is not the main holder of the data relating to liability claims.  The
Council pays insurance premiums and claims handling fees to our insurer
who take full custody and control of all liability claims (Public
Liability and Employer’s Liability), whether personal injury or other
losses, and have their own claims handling system to record claims data. 
We are able to download limited claims data to feed into our own database,
but this is not sufficient detail to fully answer questions raised.

 

In furtherance to the above, this information does not relate to any TfL
roads within the Borough, as the Council is not responsible for “trunk”
roads”.
