Dear Wandsworth Borough Council,

I would be grateful for a copy of the viability study submitted to the council in connection for the planning application for Riverlight, and a copy of any advice received by the council in relation to that study. The application site was named Tideway Wharf Industrial Estate, the planning application number was 2011/3748.

I am aware that the study was marked confidential.

I draw your attention to several judgements of the information tribunal, which have now clarified that under the EIA regulations viability assessments submitted as part of the planning process should be disclosed to the public. The most recent of this I believe is Clyne vs ICO - http://informationrights.decisions.tribu...

I previously requested the viability study for Battersea Power Station. The council initially resisted this, and I took the case to the ICO, who mandated disclosure.

I therefore hope that this request can be processed efficiently, and we can avoid the extra time that will spent on this case by all sides if I am compelled to go to the information commissioner again.

I would be grateful if you could provide me with a more complete explanation as to why this request has been delayed. I do not understand why this is considered complex. The case law is very clear, the council should disclose the viability study.

The council has already been compelled to provide me with a viability study concerning Battersea Power Station by the Information Commissioner. There is no prospect of the ICO taking a different view in this case.

Dear Requestor,

 

The report and its content does not belong to Wandsworth Council and we
required to seek permission to reuse any part of it from its authors. 
Additionally, we need to be aware of the concerns of author’s and other
third parties’ concerns over disclosure of the contents of the document
that might impact those parties negatively.  Wandsworth cannot speculate
on such impact and must seek their opinion.  The matter is further
complicated by the fact that the authors and other third parties are
private concerns who are not bound by the Freedom of Information Act in
the same way as public authorities and it can therefore take slightly
longer to obtain the information we need to be able to fully and
confidently respond to your request.

 

I do appreciate that this can be frustrating and apologise for the
inconvenience caused but I trust that the above clarifies the Council’s
position at this time.

Dear Mr Palmer,

I am very surprised to receive this response, given that after months of delay, you have simply ignored one half of my request, and not even provided a redacted copy of the original viability study that was provided to you.

In my previous correspondence I told you that I would be making a complaint to the information commissioner imminently, and having not received any response to this a complaint was made.

I will forward to them this correspondence with the request that they continue their investigation.

Finally I must add how disappointed I am with the shoddy nature of this correspondence. The authority requested a substantial amount of extra time to consider this request, on the basis that you needed to consult with the property developer who provided the information to see if they had objections to it being released. Months later that part of the request has been ignored and all that has been provided is a document commissioned by the authority themselves. This could have been provided to me months ago, without any need to consult the developer.
